In advance of tomorrow’s highly dubious Cyber Ninja’s fake Arizona Election Audit —the House Oversight Committee turns up the heat to very hot. Meanwhile the shame audit results have been delayed…
I’ve largely stayed away from the bonkers Cyber Ninjas “fake” Arizona Audit —mainly because I’m mindful of potentially amplifying disinformation but mainly because I wanted to take the “wait and see approach” —notwithstanding after seeing the Arizona Republican Party tweet -let’s just rip the bandaid off and get down to the facts…
…which announced the “delay” of cyber ninjas CEO Doug Logan and two other “auditors” delaying tomorrow’s release of their (faux) “audit” because apparently all three “may have” tested positive for COVID-19… the headline literally writes itself. Because according to this statement Logan and others are “and are quite sick” from COVID-19…who didn’t see that coming?
House OverSight Committee “request” - July 2021
on July 14, 2021, the Rep Maloney, Chairwoman of the Committee on Oversight and Reform, and Rep. Jamie Raskin, Chairman of the Subcommittee on Civil Rights and Civil Liberties sent a (pretty scathing) letter to Cyber Ninjas requesting the production of various documents and communications as part of the Committee’s investigation into the firm’s “highly unusual election audit in Maricopa County”
Pursuant to the July 14th letter, the production of numerous documents was originally due on July 28, 2021, the Committees “accommodated Cyber Ninjas’ request for an extension until August 9, 2021”
Cyber Ninjas requested a delay
the House Committee granted their request
Cyber Ninjas then produce 336 pages of already publicly available material
Cyber Ninjas then went on to lodged “several unjustified objections” to the Committee’s requests.
Cyber Ninjas that’s not how this works…
You as a private company can not continue to obstruct a lawful congressional investigation. You can try to engage in obfuscation and subterfuge but in the end your efforts will be met with the weight and authority that the constitution vests with Congress. Specifically as it relates to Federal Elections. The fact is Congress has the authority and power to investigate pursuant to Congress’s unarguable constitutional authority to regulate federal elections and thusly protecting every lawful Americans’ right to vote. Cyber Ninjas, Lin Wood, Mike Lindell, and with the incomprehensible complicity of the Arizona State Senate President continue to be aided and abetted by the likes of Chanel Rion and One American “News” —Trump’s big lie. It’s a disgrace and a clear threat to our shared democracy…

On the contrary, the Committee’s nine-page letter sent on July 14 explains in detail the reasons we are seeking these documents, specifically describes the categories of documents that are responsive to our requests, and encloses a detailed set of instructions and definitions to aid your company in making a complete and timely production of the materials Congress is requesting.
…also baselessly asserts that the Committee’s requests would implicate “attorney-client privilege, legislative privilege, and objections or privileges arising under the Tenth Amendment with respect to federal Congressional interference in a state legislative matter.” The letter further claims that the Committee’s requests are “outside of theoretical scope of a Congressional inquiry” and intended “to suppress and interfere with First-Amendment protected activity”
…The Fifteenth Amendment guarantees the right to vote and empowers Congress to legislate to protect that right. Congress has for many years enacted legislation to safeguard the right to vote and to ensure that elections are safe, secure, and administered fairly and impartially.
Supreme Court has held that Congress’s power to obtain information is “broad” and “indispensable” and that its investigatory authority “is as penetrating and far-reaching as the potential power to enact and appropriate under the Constitution.” These authorities empower Congress to investigate conduct that may infringe on the fundamental right to vote or affect Congress’s regulation of federal elections,

If your company, which purports to be acting in a lawful manner pursuing the public interest, continues to obstruct the Committee’s investigation, the Committee will be forced to consider other steps to obtain compliance.
—you get a subpoena, he gets a subpoena, she gets a subpoena—you all get subpoenas. So for now it’s a hurry up and wait…
And for now I think you’re mostly caught up on Congress and Cyber Ninjas but here’s the comical thing —Cyber Ninjas think they can play chicken with Congress. I regret to inform Cyber Ninjas, that’s not how this works, that’s not how any of this works…
…produce the requested documents or expect subpoenas and then expect the spectacle of having your CEO grilled by lawmakers in a public hearing… because that’s how DC actually works. Congress asked nicely twice, you Cyber Ninjas had your attorney write a shitty letter/response that was not grounded in facts or the law or the constitution and you think cooperating is optional. N-O-P-E bless your little hearts.
So, forgive this because it may be obvious (I’m juggling this article, waking up, and two small Tasmanian devils that I call my children), but besides Rions possible FARA investigations, and a congressional public shaming… will there be any potential for criminal charges, etc? Thank you Filey! 🌶
