Another Proud Boy: Charles Donohoe plea agreement days after Defendant Jeffrey Finley takes a plea deal

Proud Boys appears to cannibalize themselves and now at least two defendants are fully cooperating with the Government. If you think Tarrio isn’t cooperating then I can’t help you. He is.

And some of you might already be aware —but days before Defendant Donohoe’s plea agreement was announced — the DOJ quietly announced that the West Virginia Chapter of the Proud Boys, James FINLEY had also entered into a plea agreement. See below for the relevant court filings but -

Now if you know how to read the filings then you’ll note in Finley’s statement of offense —it is crystal clear the the narration “Finley saw… Finely observed…Finley noticed -Finely standing near” ←those are passive phrases that point to the Government will use Finely as a material witness against the criminal cases against the Proud Boy Leadership (Nordean, Rehl. Biggs et al) —for example I now refer you to paragraphs 7 thru 25 of Finley’s statement of Offense:

And boy what a difference nearly 13 months -makes…and read more here —And as many of you —on April 8, 2022 Proud Boy (leader) Charles Donohoe hammered out a plea agreement with prosecutors. Donohoe maximum 28 years…

The maximum term of imprisonment (combined) Defendant Donohoe was looking down the (federal) term of more than 28 years in federal prison. This also marks the first Proud Boy (leadership) has taken a plea and that’s somewhat newsworthy..

Your client agrees to plead guilty to Counts 1 and 6 in the Indictment, charging your client with Conspiracy to Obstruct an Official Proceeding, in violation of 18 U.S.C. § 1512(k), and Assaulting, Resisting, or Impeding Certain Officers, in violation of 18 U.S.C. § 111(a), respectively.

April 8, 2022 -Plea Agreement 5 years & 10 months…

Or 87 months equals seven years and three months…this is factoring in the Government’s decision to proffer a three level reduction… Meaning the parties agreed to the total level of thirty and then proffered a three level reduction predicated on Donohoe sufficiently “accepting responsibility” and adherence to the terms and conditions as set forth in his signed plea agreement

Now a couple of data points (some are not actually elucidated but rather inferred) Donohoe’s case was a “multi-defendant case” (see March 2021 Indictment via DOJ-OPA link) Also see March 2022 Second Superseding Indictment —should you be inclined you can read more about “Oh Henry…” found here or other previously published articles on Tarrio -found here.

Defendant Donohoe Statement of Offense…

Like many of you —I tend to zero in on a few facts which are typically contained within the plea agreement itself but then further expounded on in the Statement of Offense

And not that I need to say this —but— here is when you need to pay close attention because the facts are…a harbinger of a tsunami of shittlestix headed the Proud Boys and Trump’s way… so let’s get into what I think you should pay attention to… For example paragraphs one and two —what’s important here is the “his co-defendants…” and the “fourth degree…is the highest rank” (emphasis added) because this means a few things —Donohoe will testify against his co-defendants and that Donohoe was in fact a “leader” within the Proud Boy ranks.

Speculation Alert: again I would encourage you to be skeptical of my next statement because (as of now) I don’t have any documentation to support the follow but I’m going there: the notion that the Proud Boys had little or no interaction with the Oath Keepers ←is a really bad assumption.

…Donohoe joined the Proud Boys in 2018 and became the president of his local Proud Boy chapter in North Carolina. As of January 6, 2021, Donohoe was a fourth-degree member of the Proud Boys. A fourth-degree member of the Proud Boys is the highest “rank” within the Proud Boys.

As a member of the Proud Boys since 2018 and an attendee at prior national rallies attended by the Proud Boys, Donohoe knew and understood that some members of the Proud Boys—known internally as the “rally” boys—would resort to unlawful conduct to achieve an objective.

Tarrio recruited Donohoe re the Proud Boys Ministry of Self Defense (“MOSD”)

Finally because I think many of us assumed that was a fact but until now, we didn’t have it in writing from the Government that Tarrio actually recruited Donohoe for the newly established MOSD… also for now I want you to remember this name: Jeremy Bertino because as you read through Defendant Donohoe’s statement of fact —I’m 99.999% certain Person 1 (repeatedly referenced is in fact Jeremy Bertino and that’s important)

Proud Boys Ministry of Self Defense (“MOSD”)…planning and execution of national rallies and would consist of hand-selected “rally” boys. Donohoe felt privileged to be included and agreed to participate.

On December 20, 2020, Tarrio created an encrypted message group for the leaders of the MOSD. The leaders of MOSD included Nordean, Biggs, Rehl, and Donohoe. Immediately after its formation, Tarrio and others in the MOSD leadership group began making preparations for the MOSD’s attendance in Washington, D.C., on January 6, 2021. Donohoe understood that the purpose of the rally in Washington, D.C., on January 6, 2021, was to stop the certification of the Electoral College vote.

“…Everything is compromised and we can be looking at Gang charges.”

And not that this matters but I do think you should reread this August 2021 Article —Because it will help you understand pages 2 thru 8 of Donohoe’s Statement of Offense -what’s also a little bit interesting is Donohoe had no plans on coming to DC —but after Tarrio was arrested (seriously who randomly shoves a high capacity drum into your carry on —and is conveniently taken into custody) Donohoe traveled to DC.. also you need to remember that Henry Tarrio was arrested and in custody January 4, 2021 (see DC Superior Court) and as previously noted his August 2021 plea agreement Re DC charges had a very curious carve out

Because when you read pages 5 thru 8 —more specifically pages 6 and 7 —the Proud Boy’s operational security —coupled with the intense self doubt and paranoia… Commonsense would dictate that if your chairman was in custody —And you knew that —then why would you add him to the newly created encrypted chat rooms.

…It was reasonably foreseeable to Donohoe that the use of force to advance toward the Capitol would involve property destruction by members of the Proud Boys who had been led to the Capitol by Nordean and Biggs.
