And there you have it - according to the recent Wisconsin State Journal article —Blomme entered into a Plea Agreement which was docketed in late August 2021 (see ECF link) -pursuant to the terms and conditions of his plea agreement. He’s pleading guilty to two counts within the Federal Indictment. Remember there are at least two active criminal cases, one Federal the other State/County…
which is why it is paramount you read every page of each Court document the plea agreement covers both the Federal Criminal Case AND the State of Wisconsin… (see WI-DOJ link for the March 2021 State Charges) -the devil is in the details…
Terms of Blomme’s Plea Agreement
Reading the plain language of the plea agreement, specifically on page 2 paragraph 5 which reads in part:
…two guilty pleas will completely resolve all possible federal and state criminal violations that have occurred in the Western District of Wisconsin provided that both of the following conditions are met:
(a) the criminal conduct relates to the conduct described in the indictment; and
(b) the criminal conduct was known to the United States and the State of Wisconsin as of the date of this plea agreement.
…The defendant understands and agrees that if he ever successfully moves to vacate his guilty pleas in this case, he would have thereby breached this plea agreement with the United States and the State of Wisconsin, and he would thereby allow both the United States and the State of Wisconsin to pursue any and all criminal charges otherwise encompassed by this plea agreement…
His state charges are “now also resolved”…that’s one helluva sweet deal Blomme’s Defense Attorney negotiated on behalf of his client. And as of publication the Wisconsin Department of Justice has yet to weigh in on the newly announced pleas agreement…
Also I’m not a fan of plea agreements for grown men who possess child pornography — unless of course the victims agreed with Federal prosectors entering into a plea agreement. Because after all victims should have a say in any plea agreement…but the way I read the recent Wisconsin State Journal article it certainly doesn’t appear all the victims were notified…
..State Courts Director Randy Koschnick sent a letter to Peterson last month asking that the state court system be considered a victim in the case and asked that Koschnick be allowed to speak at Blomme's sentencing hearing. The letter itself is sealed in the court file, but Koschnick provided it to the State Journal.
