On January 7, 2021 Kyle Fitzsimons voluntary provided public testimony during the Lebanon Board of Selectman (BoS) meeting. You can watch the full video stream via the Town of Lebanon ME, YouTube Channel. The Town of Lebanon ME also publishes their Meeting Agenda, which also provides a hyperlink to their YouTube Chanel. At the conclusion of Kyle Fitzsimons’ public testimony, he informed the Town of Lebanon, ME BoS that the media was wrong. That what he saw “on the ground” was nothing like what the media was reporting. He then proceeded to double down on the feigned and demonstrably false narrative that it was a “peaceful protest” because he “could smell a lot of marijuana”
You’ll note the Town of Lebanon BoS breaks out into spontaneous and uproarious laughter. Which is a different kind of laugh one tends to make during an “uncomfortable situation”.
In a semi related matter, on October 27, 2019, the Town of Lebanon, appointed to the Lebanon Cannabis Committee Kyle Fitzsimons. My assumption is this followed his September 2019 Nomination a video of the October 2019 meeting confirming his appointment can be found here (see minute marker 1:07:05)
Department of Justice Criminal Complaint
According to the February 5, 2021 DOJ-OPA Press Release Kyle Fitzsimons, of Lebanon, Maine was charged by criminal complaint with;
one count of assault on a federal officer, in violation of 18 USC § 111(a);
one count of certain acts during a civil disorder, in violation of Title 18 USC §231(a);
one count of unlawful entry in restricted building or on grounds, in violation of 18 USC §1752(a);
one count of violent entry and disorderly conduct on Capitol grounds, in violation of 40 USC 5104(e)(2).
Based on the docket, Defendant Fitzsimons was arrested on February 4, 2021 and taken into Federal Custody without incident. The Government then informed the Court of their intention to file a Detention motion.
If you watch the YouTube Videos (four in total). which I edited & condensed and then uploaded my channel, you’ll note that Kyle Fitzsimons voluntarily told the Town of Lebanon Board of Supervisors; That he cycled in and out of the corridor a couple of times. And provided details of the weapons (bow and flag mast) that he retrieved from his vehicle for the “peaceful protest”, that left five (5) dead. Moreover Fitzsimons explicitly stated “we were ordered to March towards the Capitol”.
He also disclosed to the Town of Lebanon BoS that he drove down from Maine to Washington DC in a MAGA-caravan. Fitzsimoms also voluntarily disclosed that he attended the January 5th Electoral College protest. The Affidavit (ECF/PACER or via my public drive, found here) heavily relies on the January 7, 2021 video.
Fundamentally the most egregious portion of his “public comments” is Fitzsimons offensive attempt to washed himself in religion. He explained in great detail how he “got lost and ended up at the St. John Paul II National Shrine” As a quasi practicing Catholic, I find that offensive. Fitzsimons can not pervert religion to wash himself of his criminality. Furthermore in June of 2020, when then President Trump visiting this shrine. I reluctantly informed St John Paul II National Shrine that my family would no longer send our annual donation. (Eventually we will discuss my surprising position on Religious Organizations tax-exempt status)
For context Trump visited St John Paul’s less than 24 hours after he ordered the US Park Police to tear gas, beat and shoot “non-lethal” ammunition at actual peaceful protesters - because Trump wanted a photo-op in front of St John’s.
Affidavit and other Court Filings
Affidavit ECF/PACER (or via my public drive, found here) the court filings disclosed - After being struck by officers’ batons, FITZSIMONS got up and moved towards the middle of the archway; he lowered his shoulder and charged at the line of officers….Fitzsimons’ repeatedly charging at Law Enforcement, while throwing punches, much of this was captured by Metropolitan PD Body Cams.
appeared on MPD body worn camera…observed performing the same actions stated above: lowering his shoulder and charging at the police line while swinging at officers.
Law enforcement then reviewed various body cam footage from MPD and the surveillance video from the US Capitol, they issued a Be On the Lookout (BOLO) for Fitzsimons. After the BOLO was issued, a concerned citizen contacted the FBI and informed agents that Klye Fitzsimons was interviewed on or about January 11, 2021 by the Rochester Voice. In an ironic twist of fate the Rochester Voice used two photos that Kyle Fitzsimons provided the paper. Hence the photo attribution.
Fitzsmons “gave his account” of the January 6 deadly insurrection. To Fitzsimons’ credit his account closely mirrored the same account the Town of Lebanon by way of Public Input/Comments.
“…the crowd was asked by President Trump to walk to the Capitol to “give our Republicans, the weak ones ... the kind of pride and boldness that they need to take back our country”
The affidavit ECF/PACER (or via my public drive) disclosed there were three “concerned citizens” who contacted the FBI and were subsequently interviewed by agents (see pages 4 thru 9). They informed law enforcement about

In addition to other pertinent information about his currently employment and general whereabouts. The three “concerned citizens” should be lauded for helping law enforcement and doing the right thing.
On page 8 of the affidavit, it includes a December 24, 2020 Facebook Post by Kyle Fitzsimons, found here. Out of an abundance of caution I redacted Fitzsimons’ email address, as I do not condone doxing of any kind.
