I do not have anything constructive to add - as I’m sitting here in absolute shock by the Pennsylvania Supreme Court’s (SCoPA) decision.
D.A. Castor’s successors did not feel bound by his decision, and decided to prosecute Cosby notwithstanding that prior undertaking. The fruits of Cosby’s reliance upon D.A. Castor’s decisionCosby’s sworn inculpatory testimonywere then used by D.A. Castor’s successors against Cosby at Cosby’s criminal trial. We granted allowance of appeal to determine whether D.A. Castor’s decision not to prosecute Cosby in exchange for his testimony must be enforced against the Commonwealth.
I’ve only briefly scanned the filing but it appears the SCoPA found that the lower court gravely errored by allowing five victims to provide testimony of what Bill Cosby did to them. In short the SCoPA ruled that the testimony was prejudicial and thereby violating Cosby’s rights. I kind of feel sick to my stomach.
I am genuinely disgusted by this. I’ll never understand why there are statute of limitations placed on sexual assault crimes. Because one thing to remember is that the criminal charge against Bill Cosby was literally lodged with a few hours left on the Statue of Limitations clock.

Cosby trying to conflate injustices against black community with his prison sentence as if a man who had the money, power, influence & a team of top lawyers, fell victim to being imprisoned because of race. That was the biggest insult to the victims as well as any person of color unfairly prosecuted due to race. Cosby isn’t a victim, but a predator. Even denied parole because of his refusal to admit guilt. Serving 2 years only of a mandatory 3-10 year sentence is disgusting. Lastly, one hopes there is room for civil litigation against Cosby on behalf of victims unless that also falls under statute as well. Just too much…
