Per Washington Post -DC grand jury issued subpoena for those in Trump’s “close orbit” Jan6th
Per two anonymous sources: “ Subpoena requests seek information about the planning for gathering outside White House that preceded Capitol riot”
If I did this correctly this should publish as I’m jumping on my first conference call of the day. Of which four of the seven calls apparently I am required to attendance. Some dinggleberry decided to make a 7AM mandatory conference “all hands on deck” call — but as I previously stated I’m taking most of today off because I have a lot of fires and two semi emergencies that will require my undivided and uninterrupted attention. How dare my livelihood get in the way of my extracurricular Substack activities. (Note the acerbic sarcasm)
I trust Attorney General Garland & US Attorney Graves…
And so should you.
If you recall on January 5, 2022 our Attorney General made a clear and unequivocal statement on the eve of the one year anniversary AG Garland was unflinching and the solemnity of what he told the American people —it’s clear, at least to me Merrick Garland is a man of his word. Again this is exactly what Garland stated.
“…as long as it takes and whatever it takes for justice to be done consistent with the facts and the law. I understand this may not be the answer some are looking for…”
I will never fully understand why some engage in despair deza —perhaps they do this in order to keep their followers on the hook - or perhaps they do this because of their own inflated egos. Either way their criticisms are largely ubiquitous in the ever growing louder “condemnation” of Attorney General Garland. Many of these detractors might believe our AG is not moving at a pace they’ve predetermined as acceptable. I won’t go into the patriotism or lack thereof —all I know is I trust Attorney General Merrick Garland. Period. Full Stop.
Although I should acknowledge in the past I have been extremely critical of the “former Acting” US Attorney. Conversely once Matthew Graves was confirmed I decided to take my own advice and give US Attorney Grave an opportunity to lead the office.
Naturally this resulted in an purposeful retreat of my previous sharp criticism(s) of the USAO-DC and it’s “former acting” Attorney. It then occurred to me that I wasn’t being exactly fair and out of respect for the countless FBI Agents and USAO-DC staff, it made sense to give US Attorney Graves a wide berth and allow him to fully take charge of the office.
Granted it is easy to pontificate and highlighting the various deficiencies but again my criticism was secular and extremely narrowly tailored to the “former acting” US Attorney. Notwithstanding I standby my previous criticism because at the time there were a bunch of self inflicted errors. The water cooler talk might have factored into my inability to let it go… Should you be inclined you can read more here, here, here and/or more generally here. However in September of 2021 I wrote extensively how the former acting US Attorney had failed. Nor did I sugar coat my assessment(s)…
My point is, of course constructive criticism is always welcomed. But under the leadership of the “former acting” US Attorney for DC that office made several errors. Specifically between the lack of remand, especially for the Defendants who beat dozens of COPS, other Defendants were on “probation” …and over 150 law enforcement officers sustained serious injuries. Some of the injuries are permanent (loss of eye, loss of fingers etc) However at no time have I ever espoused a widespread condemnation or harsh criticism of the entire USAO-DC and more broadly the DOJ. Why? Spoiler, I actually understand the Federal Criminal Justice system.
To be exact, I understand the arduous process of criminal cases and I respect the hard work conducted by the FBI. Now that US Attorney Graves has had a few months, you’ll note that I haven’t really criticized him or his office. Perhaps it’s a naive leap of faith, but in the end I have faith in both Attorney General Garland, and US Attorney Graves. And if I ever wade into the non-constructive criticism, then I need to check myself. Largely because like many of you, I know all too well, just how much work the hundreds of FBI agents are doing and the prospectors. When individuals espouse “spare me that wheel of justice grinds slowly” ←those uninformed prognostications and it makes me want to reach through the internet and slap the stupid out of said despair deza agents of chaos. Only an intellectual midget would think that missive is appropriate. My retort is generally “then spare me Trump is mob” disinformation because the thirst and grift is real.
So speaking of facts, ICYMI shortly before 6PM (DC local time) the Washington Post published the following article. And I would encourage you to read it. It’s exhaustive and frankly irrespective of an “anonymous source” it appears a DC Grand Jury has issued numerous subpoenas. To be clear none of us (factually) know if the DOJ is in fact investigating Donald J Trump.
However we do know (as a matter of fact, not conjecture or anonymous source) that earlier this week a Federal Judge Opined that “Trump likely knew the justification was baseless, and therefore that the entire plan was unlawful..” —you can read more here, or not.
Per Washington Post: Grand Jury in DC subpoenas: planning, funding and executing the Jan. 6 rally…
Based on the March 30, 2021 Washington Post Article it appears the current US Attorney for DC has in fact empaneled a Grand Jury and that Grand Jury has issued subpoenas for some in Trump’s close orbit. It’s these two paragraphs that you should read closely because it’s important
In the past two months, a federal grand jury in Washington has issued subpoena requests to some officials in former president Donald Trump’s orbit who assisted in planning, funding and executing the Jan. 6 rally, said the people familiar with the matter, who spoke on the condition of anonymity to discuss an ongoing investigation.
The development shows the degree to which the Justice Department investigation — which already involves more defendants than any other criminal prosecution in the nation’s history — has moved further beyond the storming of the Capitol to examine events preceding the attack.
To those who continue to criticize Attorney General Garland —you should delete your account and seriously zip it —or at the minimum, perhaps you should reevaluate what you decided to post on social media. Or not.
In some respects the DOJ’s investigation (largely based upon the recent Washington Post Article) that the USAO-DC is in fact investigating Trump’s inner orbit. Again until March 30, 2022 there have been open questions. The inverse of this is (and if past is prologue) then surely there would have been a leak.
While some might view the lack of leaking as “there’s no investigation” I have the opposite reaction: “no leaks means the DOJ is doing their job” —however as previously noted —the Select Committee on Jan6th is limited in their powers to obtain evidence. Whereas the DOJ (specifically the FBI) has other tools at their disposal to (lawfully) obtain evidence vis-a-vis judicially authorized Search and Seizure Warrants. So the fact that now we know a Grand Jury has issued subpoenas —that’s confirmation that the criminal investigation is inching closer to Trump and has at the minimum reached his inner orbit.
To be clear in the past I’ve explained that the “Ginny Thomas funded busses” there’s nothing in the public domain to confirm that rumor. Yes I’m aware of her text messages to Mark Meadows (I’d recommend that you read this recent OpEd) but Meadows’ life is about to blow up (read more here, here ) and I am here for all of it. And you should be too.
As I’ve stated; Meadows life is about to blow up and that doesn’t include what certainly appears to be his wife engaging in actual voter fraud (as first reported by the Washington Post on March 23, 2022) because if the water cooler talk is correct and the fact that Joel Greenberg’s request to delay his sentencing —you do understand that Meadows and Gaetz were pretty chummy, right? And if what was told to me in confidence is correct Rick Scott should probably resign but again that’s speculation (kind of) I mean how many times have I made a prediction, largely based on facts and/or court filings.
Speaking of which did you know that you can lawfully access some grand jury court filings via the DDC website?
For Example (granted you have to know where and what to look for -in 2021 there were three Orders/Memorandums concerning Grand Jury matters;
In Re Grand Jury Investigation Memorandum Opinion and Order - Document #6 the Defendant is Thomas Robertson (read more here, here and here) the DDC Case No. 21-gj-49: In Re Grand Jury Investigation December 7, 2021 Memorandum/Opinion/Order
Partial Unsealing Order -effecting multiple Grand Juries (DDC Case No 21-gj-26) IN RE GRAND JURY NOS. 16-3, 18-1 and 19-1) docketed in August 2021. To be clear this was entirely centered around the USAO-DC request to “share Grand Jury materials” with a third party eDiscovery vendor
CAPITOL BREACH GRAND JURY INVESTIGATIONS WITHIN THE DISTRICT OF COLUMBIA (1:21-gj-00020) minute order unsealing case
Currently on the DDC’s website there is only one entry for 2022 Grand Jury -and trust me on this -that case has nothing to do with the Capitol Violence case. That Grand Jury matter concerns a protracted litigation of
APPLICATION for Access to the Transcript of Testimony before the Grand Jury Investigating Russian Interference in the 2016 Presidential Election by GIORGI RTSKHILADZE
Because if you actually understand how to read the bates numbering and then cross reference the ECF —then you can accurately and swiftly conclude that Minute Order for DDC Case No 1:21-gj-00048, see ECF for October 2021 filing by GIORGI RTSKHILADZE. (June 2020 Complaint via Scribd) Or see recent Docket Report or see below for the full minute orders -which I uploaded to Scribd —the point of directing you to the DDC website is to remind you that you can access Orders from DDC for (a few) grand jury matters. While in concert I’m trying to teach my readers how and what to look for in dockets.
The point is the Washington Post’s March 30, 2022 article is a pretty clear indication that not only is Attorney General Garland a man of his word but if that reporting is accurate then I’d say maybe give the DOJ a little bit more time and room to do their investigation. Before you decided to launch your (largely uninformed) criticism of him and more broadly our DOJ.
Again if you understand how much work goes into investigating a criminal matter, obtaining an indictment and then prosecuting those who decided to use violence in their deadly armed insurrection —then perhaps you should educate yourself before you tweet your nonsense, or not. That’s your choice, whereas I tend to focus on facts because facts always matter. And lastly I’d recommend that you read former US Attorney Barb McQuad’s recent thread. She is far more eloquent then Moi. It’s tweets 5 et seq that you should pay particular attention to. Largely because Barb McQuad speaks/tweets with authority and first hand experience. The fact is, up until March 30, 2022 shortly before 6PM (DC local time) the questions remained
Are the DOJ and FBI actually investigating those in Trump’s inner orbit?
Or is the DOJ willing to let one of the most unpatriotic event “go”?
Will Trump, Patel, Meadows, Scavino, Gosar, Jordon, Perry (Q-PA), Clark, Eastman, Navarro, Kramer, Giuliani, etc finally be held accountable for the deadly domestic attack on the citadel of our shared Democracy?
Again I’d highly recommend you read Barb McQuad’s thread. You’ll be smarter. And it might very well answer any questions you may have. It will also better help you understand the complexity and scope of the DOJ’s Jan6th investigation.
Because I wrote this article in the late evening of March 30th but then I opted to schedule the publication for March 31st. Ironically this kind of confirms: time management skills are a good thing.
And your prerequisite daily saltwater therapy —that said, if by chance you hear an eardrum piercing shrieks or feel the earth slightly quake. Spoiler that’s probably me in the midst of a contentious conference call —of which someone scheduled seven of these virtual teleconference meeting. Apparently my attendance is not optional for 5 of the 7 calls.
Be Well - Filey…
when this news broke last night, it certainly made my day! I, too, have utmost faith in Attorney General Garland. But, in this investigation, every time they turn over a rock, more cockroaches scurry away....so much crime in tfg's administration.
Worked in govt for some time and fielded many hurry up complaints from constituents over those years. My response was always that we’ve got to take the time to do it right or you will be more p.o.’d than you are. That was about potholes and crackheads, but today we’re facing existential matters. Same answer.
