Point of Personal Privilege:

..late last week my husband sent me a text which included an article about the “Trump Fake Electors” and I instinctively ignored it —part of me didn’t want the ABC News article to be true. My decision to ignore this issue is one in which I deeply regret. Now let’s just get down and dirty, shall we?

There are no such thing as Alternative Electors…

Just like there’s no such thing as “alternative facts” there is no such thing as “alternative/rogue” electors. To be clear Trump’s attacks and contempt for our shared Democracy —it hasn’t stopped. In fact I’d argue post Jan6th Trump’s attacks have emboldened and that’s beyond concerning. So let’s go through why these dozen or so individuals should “better call Saul” or at least a quasi competent defense attorney…because I think any competent and reasonable prosecutor could charge the various Republicans who knowingly signed the fraudulent documents. Off the top is my head here are a few statutes that could be in-play (note every state has various laws concerning impermissible conduct regarding elections)

• Defrauding the United States of America

• Conspiracy to defraud the United States of America

• Counterfeiting and Forgery. see 18 U.S.C. §§ 471-509 (to be clear that statute relates to Securities filings but (and yes there’s always a but) if you read Title 18, Chapter 25 you’ll note Chapter 25 is a pretty robust chapter.

• 52 U.S.C. §§ 10307, 20511 “Providing false information concerning a voter’s name, address, or period of residence in order to register to vote, or to vote in a federal election” and/or “causing the submission of voter registrations in any election, or of ballots in federal elections, that are materially defective under applicable state law”

• If the victim is a federal employee, intimidation in connection with all elections is prohibited (18 U.S.C. § 610).

• See 18 U.S.C. § 245(b)(1)(A) -Intimidating voters through physical duress in any election - voting is a Federally Protected Activity, or through physical or economic intimidation in connection with registration to vote or voting in a federal election. The authentic State certificates, can be viewed via the National Archives website. As you’ll note the documents on the National Archives correctly/factually state (then presidential candidate) Joe Biden was the victor in the same seven battleground states that Trump and his loyalist are trying to “decertify” which in of itself is deeply unsettling. Obviously on January 6, 2021 Trump’s Domestic Terrorist sought to overthrow our Government and to prevent the Constitutionally mandated (see 12th Amendment) Certification of the Electoral College Ballots - which reads in part:

…they shall sign and certify, and transmit sealed to the seat of the government of the United States, directed to the President of the Senate;–the President of the Senate shall, in the presence of the Senate and House of Representatives, open all the certificates and the votes shall then be counted; —The person having the greatest number of votes for President, shall be the President

It is now from five states (up from yesterday's three) that we have obtained forged elector documents created by Republicans.

The “forged electoral certificates” were originally obtained by American Oversight… Their report states in part;

…The fake electoral certificates were assembled by groups of Trump supporters in Arizona, Georgia, Michigan, New Mexico, Nevada, Pennsylvania, and Wisconsin who sought to replace the valid presidential electors from their state — who had been chosen by voters in free and fair elections — with bogus slates of pro-Trump electors.

January 8, 2022 -OFR notifies Michigan Governor & Director of Elections

On January 8, 2022 the Office of the Federal Register (OFR), which has various responsibilities for “some” actions related to the Electoral College and other the ratification of Constitutional amendments (see NARA) -formally notified the Michigan Governor Gretchen Witmer

…OFR informed [Governor Witmer, Chief Counsel and the Director of Elections] had received unofficial, signed certificates from GOP “electors” who had not been appointed by the governor

Michigan Attorney General Dana Nessel

Specifically AG Nessell via a criminal referral to the Department of Justice citing that the “fake Pro-Trump electors” likely violated Michigan law and unsurprisingly likely violated other election laws in, Arizona, Arizona, Georgia, Pennsylvania, Wisconsin, Nevada and New Mexico… as noted in AG Nessel’s comments but there’s some confusion.

In one report it states that AG Nessel’s request was kicked back to her office and the DOJ’s justification was “your office is better suited to investigate any violation of Michigan Election Law” but the US Attorney for Michigan has declined to comment on the January 14, 2022 referral -so it’s possible the newest referral the WDMI US Attorney may not have declined to investigate.

Furthermore in October of 2021 Michigan Attorney General, Dana Nessel and Secretary of State, Jocelyn Benson issued this press release, which detailed the various criminal prosecutions of actual voter fraud. So the specious argument that the State of Michigan isn’t protecting election fraud is in fact patently false.

Of the various documents embedded the FEC Official 2020 Election Results will help guide you through the seven battleground states that Trump & his obsequious sycophants are emboldened to overturn the 2020 election results. The reality is and based on the preponderance of evidence, there appears to be only one party in America that is hell bent on restricting Voter Rights, whereas the other party is doing everything it can to preserve and expand voting. I think it’s easy to figure out which party is in the wrong… see recent remarks by Senator Schumer because the House has passed two pieces of legislation but those bills stalled in the Senate. Don’t get me started about Sinema or Manchin or Senate Republicans. Power hungry assholes.

Arizona State Representative Jake Hoffman better find a really competent Defense Attorney - forthwith

Of all the interviews —Arizona State Rep Jake Hoffman attempted to dodge reporters but the reporters were determined to “hold power accountable” again local news is truly the best news, becoming local reporters know the “beat” of the community they are reporting on…

This local Arizona reporter and with the assist from another journalist did not let State Rep Hoffman off the hook. Furthermore this local reporter was the first to report on the actual letter/memorandum. To be clear Trump shenanigans in Arizona isn’t at all unexpected - given this isn’t the first time the Arizona Republican Party @AZGOP -nor is it a far fetched “conspiracy theory” that the current Arizona Republican Chairwoman @kelliwardaz

New Mexico Attorney General

The same day Michigan Attorney General sent a referral to the DOJ, her counterpart, New Mexico Attorney General Hector Balderas also stated that his office sent a referral to the DOJ via the US Attorney’s Office. As you’ll note (see FEC official 2020 results) in the 2020 General Election, Democrat Joe Biden won New Mexico’s five electoral. Thusly handedly defeating Trump by 11 percentage points and 99,720 votes.

I am also going to remind you that on July 26, 2021 —Deputy Attorney General Bradley Weinsheimer notified former (senior) DOJ officials (read more here)

…directing them to now provide ‘unrestricted testimony’ to the various Congressional Committees, sans asserting “claims of executive privilege”  

And while some of you might ask: what does this have to do with the House Select Committee on Jan6th and Jeffrey Clark’s November 2021 deposition. At the time I made a few general observations;

• Executive Privilege had been waived, and he had the temerity to invoke it

• Jeffrey Clark is probably one of the most unpatriotic POS ever employed by the DOJ

• The Senate had already made a criminal referral to the DOJ and made a separate referral to the DC Bar concerning Jeffrey Clark -see October 2021 article

Turning to you, Department of Justice…

Because the House Select Committee on Jan6th does not have the authority to investigate criminal acts, only the Department of Justice is vested with that authority. Conversely several State Secretary of States have already been questioned by the House Select Committee.

Notably while the various US Attorneys Office should take the lead, particularly when a State Attorney General and/or State Secretary of State sends a criminal referral that’s when main Justice should convene an election TaskForce to act as a central conduit. At the moment there’s no indication that main Justice is actively investigating the seven “alternative/rogue electors” and that in of itself is deeply problematic. Especially when you overlay the various Republicans Controlled State Government.

Many of which have pre-filed proposed legislation that would give Trump “the missing” key to his failed coup attempt. The reality is yes Jan6th was a horrific domestic terror attack but those attacks on our democracy are in fact on-going and if the Republican National Committee has their way then Trump will be emblem for the 2024 presidential election. But Trump & his seditious co-conspirators are setting the legislative groundwork to make future attempts to overthrown our Government more successful than the horrid Jan6th Domestic Terror attack. And that should make your blood run cold…
