Liberty University sues Ol’ Jerry

In a recently filed civil lawsuit, (filed Lynchburg Circuit Court in Virginia¹) Liberty University sued their former president, Jerry Falwell Jr., for withholding information from school officials concerning the…

…alleged threats for extortion and undermining the university’s moral standards…

Out of the gate Plaintiffs (Liberty University) throw serious shade, because the whole “Dr” was a long standing point of contention between Falwell Jr, his father and the University Board…so let’s do this;

The Plaintiffs seek damages but more importantly - because this largely centers around Becky & the pool boy & Falwell Jr’s behavior which directly impacted the University’s reputational standing within the Christian community writ large;

• claims damages on three counts of breach of contract,

• breach of fiduciary duty and

• statutory conspiracy.

I don’t know if Falwell had retained counsel in Spring 2020. To be clear Falwell & his wife & the pool boy was a open secret among those at Liberty and in DC firms, particularly those firms who did a lot of lobbying. In early 2019 I believe I tweeted at Falwell this song because; when you know, you know. I also knew that Falwell’s epic fall from grace was on the horizon because he is messy and so is Becki…

Also at the time I mused on Twitter that Falwell should abide by what his counsel was likely telling him “silence is the refuge of the wise - so zip it and stop making public statements because you’re giving your adversaries a ton of evidence” -any and I mean any competent attorney/firm that specializes in “crisis management 101” the playbook is very simple:

• acknowledge the behavior

• proffer a true and contrite apology, asking for forgiveness

• say that you are human and you gave in to temptations

• then ask for your family’s privacy

• and then shut your mouth and keep it shut - preferably after you’ve finished rehab

Again I don’t know if Falwell ignored the advice of counsel or he thought he could cowboy his way out of the epic “shittening” - largely self inflicted but of course the Plaintiffs included his bizarre public statements, I now refer you to paragraphs 5 and 6 of the newly filed complaint

August 23, 2020 -1,200+ word Falwell Statement

which was published in its entirety by the Washington Examiner. Incidentally that has been Falwell’s go to media/news outlet. His statement was the very worst thing a client can do.² ³ I remember when I read it and I think I tweeted “holy balls Falwell is ‘that’ client that keeps attorneys/firms up at night” because it is the truth.

Falwell is that client that every attorney/firm has nightmares about… See paragraphs 9 thru 12 in the Liberty University Complaint

“Even though I continued successfully working with our entire Liberty team to achieve so many of our goals, I am now dealing with things in a way that I should have done before — including seeking to address the emotional toll this has taken. I shouldn’t have been afraid to admit my vulnerabilities and to reach out for assistance from the mental health professionals who could have alleviated this pain and stress. I am committed to speaking out and sharing with others at Liberty the importance of seeking counseling instead of thinking you need to be tough and try to bear these burdens on your own. I am in the early stages of addressing these issues,”

The University contends Falwell breached his duties towards the university, his failure to (timely) disclose his wife Becki’s extramarital affair with Giancarlo Granda. The University then alleges from 2014 thru 2019, Mr Granda attempted to extort both Mr & Mrs. Falwell.

Plaintiffs argue that Falwell had a fiduciary duty to report the numerous extortion attempts to the Board. Yet he failed to do so. In my non binding opinion paragraphs 11 & 12 are pretty important. Two-fold meaning on one hand the allegations made by Falwell in the October 2020 lawsuit, put forth multiple onerous (purported) actions of Liberty University’s Board of Directors.

At no time, including Falwell’s Voluntary December 2020 dismissal did Falwell recant or issue a retraction. The proverbial chef’s kiss can be found in paragraph 11 “an attorney and active member of the Virginia State Bar”

Because Falwell failed to disclose, the University argues Mr. Granda, was acutely aware of the couple’s prominent roles within the university. Moreover Mr Granda was in possession of materials concerning the Falwells’ (hedonistic) lifestyle that not only clashed with the university’s moral standards but was also capable of damaging vicariously its reputation.

The Liberty Way – Student Honor Code

While most might overlook the factual predicate the plaintiffs are building - “the Liberty Way⁴” — it would also be a folly to assume this is strictly governing students and student conduct. This Honor Code applies to teachers, administrators, RA, generally speaking anyone of the university pa|

In short, no pornography, no premarital sexual intercourse, no viewing of TV or Movies that has a greater than PG, no drinking, no drugs, no caffeine… your body is a temple and created in God’s image. Yup it’s that simple.

This is what you’d call twisting the knife — the plaintiffs repeat but then add more detail as to Dr Falwell’s dual-role and vision for the school he established, then with precise brutality argues how Falwell Jr failed to honor his father’s wishes and spirituality. And the Plaintiffs then go on to construct the “family legacy” that Falwell Jr put in place by “creating a position” for his first born son Trey Falwell (see paragraphs 23 thru 28 of the complaint)

The plaintiffs make clear that Falwell Jr had an obligation to disclose

“Falwell Jr. wanted Liberty to pay severance and retirement benefits to him if Granda revealed the Granda Allegations, and Falwell Jr. thus knowingly withheld from Liberty material information that would have altered the nature of the negotiations of the 2019 Employment Agreement. Falwell Jr. said nothing of his belief that procuring Granda’s silence.”

Of course Falwell Jr did - what it indictment (see page 9, paragraph 33) the plaintiffs suggest that Falwell “enlisted high-level Washington legal assistant” for this picture to go away…

at the time there was a lot of speculation that Trump’s then “Personal Fixer” Michael Cohen made but Falwell’s failure to be truthful and forthright with Liberty University Board of Trustees - essentially left the University in the dark..

The Liberty Way apparently was Optional for Falwell Jr.

Also why does Liberty University have a “private Jet?.

The Plaintiffs buttress their injury arguments by noting that during Donald Trump’s presidency Falwell used his unique access to Trump.

During renegotiation of his employment contract, he negotiated a significant annual raise to $1,250,000, severance of two years’ pay if he resigned for “good reason” or was terminated without “cause,” and a “rabbi trust” plan for retirement benefits.

Yay Becki managed to appeal to three board members and garnered sympathy for Falwell Jr - likely pushing on the Christian edict of “.forgiveness”

BEJESUS so Liberty University agreed to pay for Falwell Jr’s rehab - again they had no idea about Falwell Jr’s hedonistic life style or his wife’s years long extramarital affair (there are plenty of rumors that Falwell Jr “enjoyed watching Becki” but again those are rumors..

Also to be clear, Liberty University is seeking

• $10,000,000 in compensatory damages

• Under Virginia law that $10M can triple which may be triple

• and 350,000 in punitive damages for Falwell’s “willful and wanton” actions that “disregarded the rights of Liberty

1. one thing you should know is there is no guarantee of appeal in Virginia State Courts, which is why I personally think this should have been filed in the WDVA Federal Court but it’s easy for me to criticize/

2. remember in October 2020 Falwell filed suit against Liberty University claiming reputational injury and defamation and economic injury. The October 2020 Lawsuit found here

3. thereafter Falwell Released a statement (in early December 2020) stating he was dropping his lawsuit; “I’ve decided to take a time out from my litigation against Liberty University, but I will continue to keep all options on the table for an appropriate resolution to the matter,” Falwell said in a statement.
