This is my area of expertise (pharma/QA). The fact that they got a contract based on their history was enough to raise my eyebrows. Their basic history suggests it was never going to result in a viable product.

Right - which is why I’m glad the House isn’t letting up- remember my countless threads from the Spring of 2020 literally tweeting WTFINGF about the billions in contracts and minimal transparency - welp here we are - la sigh

HOLY MOLY! TBH I am generally busy and zip past half the emails I get from Spicey. But then I read this one and I become mushroom cloud angry in a hot second. To think, if Dotard won this would get swept under the rug. I hope these scammers see prison time.

I didn’t mean for the “mushroom cloud of angry” but I’ve been following this issue since March 2020. After my cob - I had time to fully research today’s hearing and I was raging mad. Glad you find my reporting valuable - with typos and all -snort-

So Filey, tell me... When shit like this happens, how often does the money spent/lost get recovered? I'm sorry, but we go way back to that $600 toilet seat. How in the f'ing flux do we stop this nonsense? There are auditors and accountability people. What do they do?

I apologize, but my $1000 root canal was today. Thanks for the relief Pres Biden, because I would not have had the money without it... Now I have to save up for the cap.... fn insurance. ugh

Those are really awesome questions... I’m not going to BS you so I’ll only speak to examples that I’ve either personally/professionally been involved with;

1) it largely depends on the Ts & Cs of the contract

1a) if the “obligated money” (which is the case for emergent) is already obligated it can be difficult to claw back if the award doesn’t stipulate

1b) my guess is the Ts & Cs of this $628M award does NOT have a matrix for deliverables and tiered penalties

1c) which is why public hearings like this are important bc it informs the public but it also shines a blinding light on the awardee’s period of performance

2) stopping the nonsense really goes back to pulling the curtain behind the warp speed contracts

2a) which is difficult bc the Trump Admin didn’t use ASPR or HHS instead they used the opaque curtain on the DOD and feigned “National security”

3) I would BOLO for GAO, CBO and HHS-OIG reports because the DC machine is in high gear to be more transparent...but it takes time.

That said the House Select Committee is doing an outstanding job via public hearings

Also sorry about the root cabal <— when I’ve had them in the past my dentist suggested I put a tea bag (like Lipton tea) on the area for 5 minutes. There’s something in the tea - I think it’s the tannic acid that calms the nerves down. Hope you feel better soon and o hope my answers provide useful information —sending you a virtual hug

I know you deal in facts and only the facts, but do you think charges of some degree of murder or something can be filed, since they didn't meet the requirements and most certainly caused deaths due to Covid?

I genuinely believe that Trump et al should have been charged with “gross criminal negligence” that resulted in hundreds of thousands of deaths. But I can’t see that as a viable remedy bc they would largely argue some type of immunity but I can tell you that I know of 4 State Attorneys General that have openly discussed this as a possibility but again it would be a protracted litigation battle. Plus I think it’s hard to prosecute any Fed in state court bc of the supremacy clauses and certain privileges of sovereign immunity etc
