“I will support and defend the Constitution of the United States against all enemies, foreign and domestic…”
That oath isn’t just words. That oath is a sacred promise that a public official makes upon swearing into office. Requiring “public trust” and its a solemn oath which transcends all political parties
I do solemnly swear…if you’re Trump you swear allegiance to being a grifter in chief…
Pursuant to 5 U.S. Code § 3331 - Oath of office —this oath is applicable to nearly all public servants in the Federal Government…
An individual, except the President, elected or appointed to an office of honor or profit in the civil service or uniformed services, shall take the following oath: "I, AB, do solemnly swear (or affirm) that I will support and defend the Constitution of the United States against all enemies, foreign and domestic; that I will bear true faith and allegiance to the same; that I take this obligation freely, without any mental reservation or purpose of evasion; and that I will well and faithfully discharge the duties of the office on which I am about to enter. So help me God." This section does not affect other oaths required by law. (Pub. L. 89–554, Sept. 6, 1966, 80 Stat. 424 .)
Again this oath is grounded in the “public trust” and that the person who swears on this oath is bound by an indisputable fact of one fundamental tenant:
I will support and defend the Constitution of the United States against all enemies, foreign and domestic…
This sacred oath means that the public servant swears fidelity to our constitution. Not to a single man/woman. Not to a political party. The solemnity of this oath isn’t about the words. It’s about what a public servant is lawfully, morally and ethically required to do —otherwise they must discharge their position.
Conversely you’ll note that the presidential oath is different then 5 U.S. Code §3331 —the presidential oath is part of our Country’s Constitution and it reads in part:
Presidential Oath…”preserve, protect and defend the Constitution of the United States”
To be clear, when a president places their hand on the Bible and utters the oath, pursuant to: ArtII.S1.C8.1 Oath of Office for the Presidency that is a sacred covenant to the American people.
Before he enter on the Execution of his Office, he shall take the following Oath or Affirmation:–I do solemnly swear (or affirm) that I will faithfully execute the Office of President of the United States, and will to the best of my Ability, preserve, protect and defend the Constitution of the United States.
Donald J Trump betrayed his oath of office.
Donald J Trump betrayed the American people.
Donald J Trump’s lies cost too many Americans their lives.
Donald J Trump didn’t just incite the deadly insurrection. He helped plan and fund it. He was literally jubilant as thousands of his MAGA Supporters invaded our Capitol. Trump cheered when his supporters beat the ever loving shit out of hundreds of law enforcement officers. Donald J Trump never bothered to call fallen US Capitol Police Officer Brian Sicknick’s family
If you recall shortly after January 6, 2021 some of us repeatedly stated that Trump did not call the Department of Defense. Trump did not send the DC National Guard (because Washington DC is not a State) and each State Governor is the Commander in Chief of their respective State National Guard. Therefore the commander in chief of the DC National Guard is in fact the President of the United States. Again at no time did Donald J Trump use the powers vested in him by our Constitution to “put down the insurrection” —in March of 2021 I specifically pointed out the importance of (Ret) General Walker and I further elucidated why his testimony was so incredibly damning.
Moreover in March of 2021, I explained that General Walker came to the committee with receipts. That the Department of Defense never received a call from our Commander in Chief. And more importantly why on January 8, 2021 the Department of Defense sought to contemporaneously memorialize what happened on January 6, 2021 but more importantly what did NOT happen

Not to belabor the points - the GOP and Trump have forfeited the right to the claim of “the party of the Rule of Law” - those seeking to blame the US Capitol Police or Metropolitan Police or the FBI or the DC National Guard - for the January 6th Insurrection aka act of Domestic Terrorism - stop. just. stop your anger should be pointed towards Donald J Trump, his obsequious sycophants and frankly the top brass at the Department of Defense.

And while some might criticize the June 9, 2022 HSCJ6 first public hearing —one can not help but wonder:
are you criticizing this committee because they are shining a big light on the truth and facts?

Irrespective of what the answer is to the two aforementioned questions —I personally believe the HSCJ6 first hearing was stunning, unprecedented and that the threat to our Democracy is ongoing and persistent. June 13, 2022 HSCJ6 second hearing:
…which now brings us to the HSCJ6’s second hearing, June 13, 2022 —the majority of this hearing really drilled down on decapitating Trump’s “he didn’t know” to be clear the HSCJ6 has done (in my view) an incredible job of completely annihilating Trump’s specious “I was perfect” narrative but more importantly the HSCJ6 spent the June 13, 2022 hearing setting the foundation of “Trump’s state of mind” —and that’s really important, should the HSCJ6 make an unprecedented criminal referral of Donald J Trump to the Justice Department.
Trump raised $250M —on the day of his insurrection he sent out a campaign fund raising email…
Of the quarter of a BILLION dollars Trump raised —he did not use those funds to “fight in court” —Kimberly Guilfoyle was paid for her Jan6th comment. The Green Team focused on following the money. The tonight that the DOJ could make a viable case of actual wire-fraud is much stronger that you think. Moreover the lies said and amplified by Trump and the likes of Fox “News”
Perjury, False Statements, and Obstruction of Justice - 18 U.S.C. § 1621 actually criminalizes “perjury” and 18 U.S.C. § 1001 - false statements, which reads in part:
…knowingly and willfully . . . make[] any materially false, fictitious, or fraudulent statement or representation” in the course of “any matter within the jurisdiction of the executive, legislative, or judicial branch” of the federal government. There’s no requirement that the statement be under oath.
Additionally pursuant to 18 U.S.C. § 1505, it is a felony offense for anyone who
“corruptly, or by threats or force, or by any threatening letter or communication influences, obstructs, or impedes or endeavors to influence, obstruct, or impede the due and proper administration of the law under which any pending proceeding is being had before any department or agency of the United States, or the due and proper exercise of the power of inquiry under which any inquiry or investigation in being had by either House, or any committee of either House or any joint committee of the Congress.”
One thing most people won’t tell you is 18 USC §1505 has an accompanying code (that many actually overlook) pursuant to , 18 U.S.C. § 1515(b), defines “corruptly” as “acting with an improper purpose, personally or by influencing another, including making a false or misleading statement, or withholding, concealing, altering, or destroying a document or other information”
But the fact that Donald J Trump and his campaign raised over a quarter of a billion dollars is the biggest fraud perpetrated in recent memory… and trust me on this watch the >$250M+ space it’s going to come back and bite Trump is his fat old man ass. Presidential Pardons after the Big Deadly Lie:

The latter (Jim Jordan) is speculation on my end —I came to that conclusion after Jordan’s vexing responses to questions of whether he talked to Trump on January 6, 2021–coupled with Jordan’s (now twice) refusal to comply with a HSCJ6 subpoenas. So I’m not 100% confident that Jordan personally sought a presidential pardon for his active role in Trump’s conspiracy to overthrow our Government. Similarly what do the aforementioned four House Republicans have in common:
Freedom Caucus (the irony is not lost on me)
Refusal to comply with the HSCJ6 subpoenas, yes plural subpoenas
Rep Scott Perry & others approached the White House seeking a presidential pardon..
Here’s your January 9, 2021 Rep Scott Perry baseline (in his own words) I’m old enough to remember a certain PITA who literally stated in 2021 “are we ever going to talk about Rep Scott Perry & Clark?” -not only did I transcribed the Handwritten notes from a the December 27,2020 telephone call with Trump (see my Scribd Link) I explained that Perry was in it —up to his eyeballs.
In December 2021 I explained that Perry and Jeffery Clark go way back. You can read more here and here. Additionally — Furthermore Vice-Chair Cheney also stated in the weeks after the deadly Jan6th insurrection, that several other members of Congress contacted the White House seeking a presidential pardon. That in of itself a textbook consciousnesses of guilt behavior. And you better believe that the HSCJ6 likely has multiple receipts concerning a presidential pardon for “acts” they did in the furtherance of Trump’s seditious conspiracy to overthrow our government.

In February of 2021 I asked a very and I mean very basic question regarding the DOJ and the deadly “domestic terrorism” attack aka Trump’s insurrection. …again the point of the HSCJ6 June 13, 2022 hearing was to lay down a predicate for Trump’s two fold: mens rea actus reus —specifically Trump’s state of mind and the actions he took (and in the case of the DC National Guard and more broadly the Department of Defense) and did not take. All of this evicerated Trump’s “oh he didn’t know he was lying” that myth has now be annihilated by the testimony of Trump’s; own family, Campaign Staffers, Data Staff, and an entire cadre of Trump attorneys. Bottom line is Trump absolutely knew he lost the 2020 election and that his big lie was absolutely deadly.

…additionally I need to take a few days off from writing. Last week I met with a grief counselor (again many thanks to my readers who gently suggested that I needed help) —I’m intentionally honest enough to admit that I actually need professional help to assist me navigate through the death of my former boss. I also realized over the weekend that I have (unintentionally) neglected my family. I won’t go in to the details because the situation is delicate. It involves individuals that I care about and other individuals who were “friends” until they were not.
So I need a few days to get my house (and my head) in order. But I don’t want my readers to think I intentionally left them in the lurch. At the advise of the grief counselor I realized I had spread myself entirely too thin and that I may not have properly grieved the past suicides in my life —so when my former boss died it uncorked years of grief that I never actually dealt with. To be clear it’s not a weakness to admit that you need help, it’s the opposite, it takes a strong person to ask for and seek help.
At any rate I hope to return to Substack by the end of the week but felt an obligation to walk my readers through a series of complicated facts and to further explain the June 9th and 13th HSCJ6 heatings. As I’ve said, I have absolute trust and faith in the HSCJ6b and you should too.

Thank you for starting this issue with the Oath to the Constitution. Even I, as a lowly Peace Corps Volunteer, took that oath and to this day, I honor it. If we do not preserve and protect our Constitution our ongoing experiment in Democracy is over.
