Let’s drill down on the good bits of Greenberg’s Plea Agreement

as I mentioned earlier when my smartphone sent me a docket alert I was on I95 North Bound. I then pulled over at a Rest Stop to quickly scanned the docketed plea agreement which is embedded in the previously published article and then uploaded it. At the time I stated I didn’t read the entire document. My standard practice is to read the whole document and then pontificate. Now that I’ve returned to the DC Bubble and read the entire document…

Anatomy of Greenberg’s Plea Agreement 3 parts

I think a brief primer to explain in non-legalese the three components of Greenberg’s Plea Agreement might be beneficial;

Part 1 Pages 1 thru 24 the actual plea agreement - notice that April is marked out and that the date of signatures is May 12, 2021 - this gives credence to the reporting in early April 2021 that the parties were in the midst of negotiations.

Part 2 - Pages 25 thru 27 - PERSONALIZATION OF ELEMENTS - In Greenberg’s plea agreement you’ll note this section is broken down to the counts Greenberg has agreed to plea guilty to. Each of those Counts ask various questions as it relates to Greenberg’s Actions. For Example;

Part 3 - Pages 28 et seq - Factual Basis this portion of the Plea Agreement answers the questions asked in the personalization of elements (Part 2). And it is granular in detail. So now that you have a decent primer, let’s dig in, shall we?

Factual Basis - Plea Agreement

Which is located within the signed plea agreement, pages 28 et seq and fair warning the details are both interesting and headache inducing- especially concerning the various shell companies Greenberg created, the acquisition of cryptocurrency and the SBA/PPP loan(s). It’s a lot of facts and data.

Count One:

Note “commercial sex act” colloquially known as prostitution, aka “Baby fammi essere il tuo papà zucchero” (loosely translates to; Baby let me be your sugar daddy)

“he paid women for sex…disguised the payments as ‘school expenses’ or other living expense…”

Notice the last sentence - the “others” appears a lot in the factual basis specifically concerning the Minor and commercial sex acts. That affirmatively indicates other men.

Greenberg used an account at the Website to identify women whom he later paid to engage in sex acts with him and others

During the course of tawdry conduct, investigators concluded that Greenberg used four accounts to pay for sex;

• personal Venmo

• personal American Express

• Tax Collector’s Office American Express, and

• his personal account at Fifth Third Bank.

During a two year period of December 2016 thru 2018 respectively - using the aforementioned accounts there were a lot of transactions. For Example;

Greenberg initiated more than one hundred fifty (150) separate transactions, which totaled over $70,000.00

Greenberg’s Venmo transactions were often $500 to $1,000 - falsely representing the purpose of the payments as school-related supplies or being other related living expenses…

Greenberg the Minor & a “Sugar Baby” website

The phrase that should make a few folks like Gaetz completely lose their ever loving minds;

”…one of the individuals who Greenberg paid for commercial sex acts was a minor, under the age of 18 for part of the time when Greenberg paid her to engage in commercial sex acts with him and others”

And for the record the “gossip” that a minor “may have been involved and possibly sex trafficked” this is no longer a rumor or “locker room talk” —the materiality of facts educed in the factual basis portion of Greenberg’s Plea Agreement is absolutely and devastatingly substantial. For Example on page 30 of the Plea Agreement;

The first meeting occurred on his boat…paid the minor $400… no sex act was preformed…they met at hotels throughout the Middle District of Florida…

…often with others…Greenberg engaged in commercial sex acts with the minor in the Middle District of Florida on at least seven times when she was a minor… …introduced the minor to other adult men, who engaged in commercial sex acts with the minor

Well now that’s interesting - in the Greenberg Plea Agreement - Factual Basis many of the “commercial sex acts” occurred in various hotels throughout the Middle District of Florida. Greenberg literally used Florida’s D.A.V.I.D. system to stalk the minor he repeatedly had commercial sex acts with.

”used Tax Collector Office credit cards to pay for hotel-rooms…Greenberg used his access to DAVID to look up and investigate his sexual partners…

Greenberg agrees and acknowledges that he acted in a reckless disregard of the fact that the Minor was less than 18 years old when he engaged in commercial sex acts with the Minor…

Remind me who’s the parent company for Embassy Suites¹—oh that’s right it’s Hilton - one of forty defendants being sued by two sex traffic victims that allege numerous hotels in the Middle District of Florida allow sex traffickers to use their hotel rooms for “commercial sex acts”…

…the Minor to engage in commercial sex acts with the Minor in Greenberg’s presence…

Page 32 is worth reading closely - especially the part that I underlined because this clears up past conflicting media reports. Not to belabor the point - it’s a Factual Basis… and both parties had to sign off on the documents- hence notice Defendant’s Initials on the lower left hand corner of all 89 pages?

“…especially given the number of times that Greenberg paid the Minor to engage in commercial sex acts with him…number of times they texted and talked on the phone…the fact that other men who Greenberg introduced the Minor to engage in commercial sex acts with the Minor in Greenberg’s presence”

Greenberg contacted the minor - directly and through a friend… the purpose of asking the Minor to lie and say that the reason why Greenberg looked the Minor up in the DAVID system…Greenberg knew, was not true…Greenberg asked the Minor for help making sure that their stories would line up…

With respect to the other two victims, whereby Defendant Greenberg engaged in identity theft. Accessing D.A.V.I.D. and purloining returned drivers licenses that were set to expire - but on 37 - there’s an interesting disclosure, upon law enforcement executing a judicially authorized search and seizure warrants… Investigators discovered Greenberg had three fake diver’s licenses; Canada, Virginia and Florida. I for one did not have Canada on my Greenberg bingo card, did you?

Well that should clear up any reservations of the veracity of the local Florida Newspapers because there it is in black and white - Factual Basis of his Plea Agreement;

Witnesses who were present when Greenberg was with some of the women, who Greenberg paid for commercial sex acts…observed Greenberg offer some of these women use of a stolen [drivers] license from the Tax Collector’s Office…

The Government presents a dichotomy between Greenberg’s short and long term objectives. You’ll note the Government made a clear delineation;

He used his access to the accounts and funds of the Tax Collector’s Office to engage in a scheme to defraud…enabled him to deprive the Tax Collector’s Office and Seminole County…of the use and benefit of those funds…

In some cases these deprivations took the form of short-term loans …which benefitted Greenberg personally… In others, Greenberg intended a permanent deprivation

The next fifty pages in the factual basis are a recitation of previous facts detailed in Greenberg’s original indictment, the first superseding indictment, the second superseder and finally the third superseding indictment.

In short pages 39 thru 89 (the Factual Basis part of the plea Agreement) is indicative of Prosectors utilizing forensic accounting - because in the case of Greenberg’s “follow the money” it took a dizzying amount of turns and uncovered payments more than 150 payments for commercial sex acts, embezzlement from the Tax Collector’s Office, BitCoin (and other cryptocurrency), Crypto-Mining, and SBA loan Fraud.

Yet the questions remain; who and what did Greenberg give up? Where did all this money go (beyond the >$70K toward commercial sex acts)?

I mean clearly Matt Gaetz has long been one of my favorite pet projects², did people think I was pulling these things out of thin air? I genuinely want to know when we can talk about his State of FL financial disclosures versus his House of Rep financial disclosures. No kidding in December 2019 I did the tedious research of pulling Gaetz’s State of Florida Financial Disclosures and cross referenced them with his Federal Financial Disclosures see Dec 2019 archived thread because I also noted that Gaetz’s loan from his daddy (it fluctuated between $25K to $70K magically disappeared with no record of how he retired that loan. So let me know when we can talk about that too…
