On January 9, 2021 an anonymous tipster (T1) contacted the FBI. T1 went on to disclose that Messer & Borgerding had posted on Facebook and subsequently uploaded and published videos via YouTube and identified three individuals - Defendant Borgerding’s husband hasn’t been charged…

A Facebook Account with a vanity name “Therese Maurer Borgerding” stated

“Walt was there. You weren’t. You have NO story to tell. You might want to shut your mouth.”

Google Location services, Google Maps and then GeoFencing - but stunningly is the Defendants used Google Maps to drive to/from Ohio to Washington DC January 5th thru 7th…the level of deep stupid here and a whole new bottom

..movement of Walter J. Messer as he traveled from the Dayton, Ohio area to the Washington D.C. area on January 5, 2021. Walter J. Messer’s location in and around Washington D.C and the United States Capitol Building on January 6, 2021, was also located in the provided records.

A travel route from Washngton D.C. back to Ohio on January 7, 2021 was located…Maps showing the travel and locations are below, including travel from Dayton, Ohio to Washington, D.C. on January 5, 2021,and returning from Washington, D.C. to Dayton, Ohio on January 7, 2021.

A review of the [redacted] revealed seven YouTube videos posted by the account. The videos depict the events of January 6, 2021, from both inside and outside of the United States Capitol Building. In the video from inside the United States Capitol Building, the United States Capitol Police can be seen inside the Rotunda on the opposite side pushing back outside. In one of the videos, Therese Borgerding is seen moving erected metal barricades and entering the grounds of the Capitol

I don’t know why someone didn’t archive his YouTube Channel and to be clear he has two separate Youtube Chanels and just in case YouTube decides to suspended his account

Walter Messer - YouTube Channel six videos that he posted on January 7, 2021 -since no one had actually archived this particular YouTube channel I went ahead and archived it on the Wayback Machine

His second YouTube channel -appears to be exclusively used for his roofing company - but it’s page 13 of the Affidavit in support of the criminal complaint thats both hilarious and dumb. Dude thought buying a new smartphone would somehow not link to his YouTube, Gmail and service provider account info.

A twice failed political candidate Daniel CHRISTMANN, who’s campaign biography reads as follows:

on July 28, 2022 was arrested by Federal Authorities —it also appears by Chrostmann (now deleted) Facebook account his friend “jake” and his campaign manager (summer of 2020) was also arrested (sometime between Jan 6th thru Jan 18th) -see page 18 of the affidavit— hence why one should always and I mean always read every page of a court filing..

Two tipsters provided information about posts purportedly made by DANIEL CHRISTMANN to , including screenshots from videos depicting images inside the U.S. Capitol on January 6, 2021. According to records provided by Facebook, Instagram account “dannyforsenate” is registered to “Daniel Christmann”

For those who are unaware, speaker PELOSI’s staff huddled in an inner-conference room with the lights out and the door barricaded. Meanwhile countless domestic terrorist were pounding on her office door - Speaker PELOSI’s staff made urgent calls —often whispering as to not give the Domestic Terrorist a clue where they were hiding. These aren’t just QANON-MAGA Trump supporters —call them for what they are:

Your affiant compared a booking photograph of CHRISTMANN, captured by the New York City Police Department (NYPD) on August 15, 2020, to the profile picture on the Instagram account discussed immediately above, and the two are consistent…

This isn’t tourism this is Domestic Terrorism —and I’m tired of those Republican members of Congress and the Rightwing media continually diminishment of what January 6th was - it was Trump Domestic Terrorist committing numerous acts of terrorism. There I said it and deep down you know it’s true.

Based on my training and experience as well as the physical surroundings, I believe this crowd assembled enforcement personnel meant to prevent access to the U.S. Capitol building; several of the law enforcement officers are in what I recognize as “riot” gear….CHRISTMANN in the video stills below in yellow

USCP security cameras captured images of individuals unlawfully entering and rioting inside the U.S. Capitol building on January 6, 2021. Based on my knowledge of the events on January 6, 2021, the Senate Wing Door was a significant point of entry for rioters.

…I have reviewed security camera footage covering the Senate Wing Door, and several still images are below. Based on the picture of CHRISTMANN posted on the profile page of Instagram , the arrest photograph of CHRISTMANN captured on August 15, 2020,, Tennessee, and California drivers license photographs, and the two images of CHRISTMANN in the crowd referenced immediately above at the U.S. Capitol on January 6, 2021, your affiant located CHRISTMANN on security camera

Did you storm the Capitol? “scaling walls and shit”

In addition, between January 7, 2021, and January 12, 2021, CHRISTMANN affirmed in multiple conversations on that he entered the U.S. Capitol. In one such conversation on January 7, 2021, an individual asked capitol. CHRISTMANN responded “Yeah im not going to lie” —CHRISTMANN went on to say “I wasn’t one of the first people in” and was “scaling walls and shit”

In addition, on January 18, 2021, CHRISTMANN sent the following private messages using Facebook Account “Daniel.CHRISTMANN.14” directing the receipients ¹ (sic) to “delete” and “remove those videos” after two friends of his had recently been arrested

Defendant James R. DAVIS - former Marine & MP

Why didn’t the Government at least make an oral motion to detain Defendant James Davis - this is just frustrating because the facts proffered in the affidavit, Defendant Davis assaulted numerous law enforcement officers numerous times. And I genuinely do not understand why the USAO-DC didn’t at least make an oral motion to detain him -

Charges - how was he NOT detained pending trial?

18 U.S.C. § 111(a)) (Felony) - Assaulting, Resisting, or Impeding Certain Officers,

18 U.S.C. §§ 1752(a)(2) and (4) - Disorderly and Disruptive Conduct and Engaging in Physical Violence in a Restricted Building or Grounds,

40 U.S.C. § 5104(e)(2)(F) - Act of Physical Violence in the Capitol Grounds or Buildings,

18 U.S.C. § 231(a)(3) - Obstruction of Law Enforcement During Civil Disorder.

charged with federal offenses that include assaulting, resisting or impeding certain officers and obstruction of law enforcement during civil disorder, among other charges. Davis made his initial court appearance in the District of Columbia this afternoo…Davis was on the west front terrace stairs of the U.S. Capitol where he engaged in a confrontation with law enforcement officers who were trying to protect the building from rioters. As depicted in body-worn camera (BWC) footage, Davis charged toward officers while wielding a large stick. After an officer shouted for Davis to move back, he allegedly did not follow the command and again charged at the officers.

The Affidavit (see DDC-ECF ² is…in a word… pretty upsetting especially when you recall last week’s excruciating testimony of the four Law Enforcement Officers (LEO). I don’t know why the Government didn’t seek to detain him - especially since he assaulted LEOs ³

Based on a tip submitted to the FBI, the affiant performed a review of three videos that contained footage of a subject who occupied restricted areas of the Capitol Grounds and assaulted police officers on January 6, 2021. The complainant alleged the individual in the Capitol footage was James DAVIS of Virginia, who was identified by name in a photograph on www.NTD.com, a publicly-available news site.

The affiant compared the captioned January 6th footage to the open￾source news photograph of James DAVIS and confirmed that DAVIS likely participated in the violence at the Capitol. Following the review of the three videos, body worn cameras (BWC) of Metropolitan Police Department (MPD) Civil Disturbance Unit (CDU) 51 were reviewed by the affiant to further identify the Subject’s actions and the assault on a Federal Officer on January 6, 2021

DAVIS confronts Officer/Victim 1, pushing and screaming at Officer/Victim 1, as captured in Image 3. Officer/Victim 1 shouts at DAVIS to back up before shoving DAVIS to the side. DAVIS does not follow the commands of Officer/Victim 1 and again charges toward the officers. Image 4 captures DAVIS as he approaches and confronts Officer/Victim 2. DAVIS continues to shout at the officer and pushing the officers hands down as Officer/Victim 2 attempts to stop DAVIS’ advance. After pushing Officer/Victim 2’s hands two separate times…

In one of the BWC videos, the individual believed to be DAVIS pointed to his U.S. Marine Corps ball cap, captured in Image 2, and stated, “I fought for this country, I fought for this country, what the fuck are you doing, I fought for this country, I fought for this country, I’m a military fucking police, I’m a military police,” as he pushed officers while wielding the large stick/pole.

I am trying my level best refrain from being overly critical of the USAO-DC but after reading the Affidavit, watching the various YouTube and Facebook Videos and then seeing that 1) the Government did not request detention, 2) that Defendant Davis doesn’t even have GPS or RF monitoring, 3) there is no actual date for Defendant Davis to surrender his firearms, and 5) Defendant Davis was RoR’d meaning he wasn’t required to put up any funds.
