But I'm confused my friend. How did a Grand jury convene and come to a conclusion is AG Garland WASN'T doing his JOB?!!! Isn't he supposed to stand on the steps outside the building with BULLHORN and let everyone know the grand jury is convening.....oh wait...that's not how any of this work....

IKR? Yet that doesn’t seem to deter the Blue QANON who frankly tweet so much disinformation and garbage. The DC Grand Jury was Sworn in on May 25,2021 -i think most are overlooking the speed in which US Attorney Graves & AG moved to secure this indictment

Attacks on Garland have been infuriating. Not one Blue Anon account has any grasp of the law nor how the committee works or even how the laws work concerning investigations and indictments. It was a grand jury that handed down this indictment and Garland has never once waivers from his determination to hold those responsible to letter of law. This blue anon trend to disparage the DOJ and specifically Garland, instigates trouble. People will become fatigued or feel hopeless, which doesn’t help drawing out voters for midterms. It’s so upsetting to see. Ego, need for attention & constant praise on a social media platform that has time stamps proving these people can’t possibly have jobs if every hour and minute is spent tweeting. There are a lot of people dedicated to uncovering the truth and following the legal procedures to get at the truth. Thanks for reminding us that a commitment to facts is only way forward. Thanks Filey.

I just added to the article -see 8PM update —

1),US Attorney for DC -the senate didn’t vote on his confirmation until Oct 28th

https://www.congress.gov/nomination/117th-congress/925

2) The House Select Committee on Jan6th didn’t transmit the criminal referral until after the Oct 19th Committee voted

https://january6th.house.gov/news/press-releases/thompson-cheney-opening-statements-select-committee-business-meeting

So in actual (factual) terms the DOJ did in fact move rather quickly

Thank you. On some level, the accounts attacking Garland from left, survive & thrive when country is in perpetual crisis as it was 2016-2020. There is selfish need to keep followers invested. Only works if Dems lose or don’t turn out to vote. Sometimes I think they want to lose to keep their audience. It sounds so cynical & borders on conspiracy but can’t help wonder what end game is by attacking an AG appointed by a Dem President. We need all hands on deck. Virginia governor race should be a wake up to us all.

For me their”thoughts/opinions” are antithetical to real American values. And no I don’t think your assessment is flirting with conspiratorial narratives. It’s a well seasoned observation but I did realize that my readers likely didn’t have an accurate or factual timeline of the indictment. As a society we are conditioned to “immediate gratification” when the reality is the wheels of justice do grind slowly —and it made sense to give my readers an accurate and sourced timeline of this indictment -I make zero apologies for my thoughts on the Blue QANON. They need to STFU and let the DOJ do their job -versus acceding to their uninformed prognostications. <—see I can be quasi professional <snort>

I’m so grateful for that. I’d rather understand the process and the facts.

Seems to me, we didn’t have nearly enough info on this little crucial nugget, and whomever BlueQ might be, even today on network news it was all “Garland” and zero USAO-DC. 🤷‍♀️

“And as you’ll note the USAO-DC now has a Senate approved US Attorney leading the USAO-DC and that’s something of a acute significance.”

IKR? All the Blue QANOn ratchety rhetoric of gunning to have AG Garland fired -you dumb recalcitrant ignoramuses - you don’t even know the difference between a criminal complaint v indictment— I mean clearly it’s not like I rattled off this article in <25 minutes of the DOJ-OPA press release -nope it was in my queue and I was told to hold off because of the GJ -

OMG! I have been out of sorts the last 10 days and finally got my mind together to read your Newsletters. I had to start here. Thank you, File-y! I have so much to catch up on.

I just wanted to thank you for the breakdown and clarification so I understand the Grand Jury and how this took place. I so appreciate your work: I am sure I speak for many! Here is to hoping you have a great weekend.

I was going to send a SOS via smoke signal because your absence was definitely noticed, at least by me.

I’m sorry you’ve been out of sorts. Sometimes life can be extremely overwhelming. But I know you.

You’re strong. You’re a force of nature.

I don’t know if this will be helpful or might be a necessary respite from the craziness -so you might want to follow this Instagram account -purely dedicated to daily beach videos (I’m not joking in the past 11.5 years I have literally thousands of videos)

LOLs okay Bre/Brenda -I’ll take your unsolicited opinion under advisement and then use it to pick up my dog/cat poops. Oh and how’s the 2nd hand junk store you’re running? Do you enjoy sipping your sweet tea while being a troll?

I am genuinely honored (j/k) —that you’d take the time out of your otherwise very busy trolling schedule and grace me with your self righteous nonsense.

For the record Brenda/Bre it’s not exactly smart commenting here because in doing so you’ve proffered some of you own PII…but given your proclivity to amplify provable disinformation and tweeting some hilarious intellectuallly challenged tweets -I’m not at all surprised that you’d come to this platform…does this sound familiar?

Your blind defense of a man who has preyed on numerous women isn’t laudable it is acting pretty sad. But Brenda/Bre you do you and I’ll continue doing me. Deal?

Geez Brenda;Bre -I am sorry about your 2nd hand junk store flopping due to COVID-19 -actually I’m not at all sorry.

Perhaps you’re the one who should seek professional help for the bitterness, rage and hate you have for other women that causes you to be a useful troll & cross pollination of social media platforms ergo cyberstalking & continued harassment

Incidentally it must be really exhausting to carry around that much bitterness —but hey you do you and keep on trolling- bless your kiddo’ heart Brenda

I hope this explanation is helpful and I apologize for its wordiness;

11/12/21 indictment unsealed, an arrest warrant was issued

11/15/21 AM -Steve Bannon via his counsel have agreed that Bannon will self surrender on Monday morning.

11/15/21 PM Bannon will make his initial appearance, the court might combine that with an arraignment (but that’s not a 100% lock) it’s up to the Judge’s prerogative and likely predicated on Judge Nichols’ calendar. At the 11/15 hearing it’s possible that will concurrently conduct a bond hearing

Once an initial appearance and arraignment (that’s when the Court reads the indictment in the presence of the Defendant) occurs then we move to the next phase;

Defendant Motion to Dismiss (he’ll likely argue that this is a selective prosecution) or some other random reason to support his MTD.

Around 7PM this evening the US Attorney (AUSA) Amanda R. Vaughn filed her notice of appearance (NoA) on behalf of USA, conversely Bannon’s defense counsel has yet to file a NOA (that will likely hit the docket on 11/15)

I’m spitballing here (please do not take this a gospel) I can see a determinative outcome where the Court Orders Bannon to comply with the subpoena (17 categories, all communications, logs, etc) and the Select Committee reschedules a new date for both the records and oral testimony. Bannon shows up and basically answers zero questions and/or invoking his various constitutional rights:

5th Amendment👇🏻

https://constitution.congress.gov/browse/essay/amdt5_4_1/

Grand Jury, Double Jeopardy, Self Incrimination, Due Process, Takings but again so many falsely amplify the “I plead the 5th” You don’t plead the 5th you invoke your fifth amendment rights, on specific questions

8th Amendment 👇🏻

https://constitution.congress.gov/constitution/amendment-8/

which prohibits the federal gov from imposing “unduly harsh penalties” both before and after a conviction on criminal defendants -equally to the price for “obtaining pretrial release and the punishment for crime after conviction”

In 1998 USA v. Bajakajian, 524 U.S. 321 (1998) -aa landmark case. This was the very 1st SCOTUS held that the Excessive Fines Clause prohibits fines that are "so grossly excessive as to amount to a deprivation of property without due process of law".

See Law Library of Congress

👇🏻11th Amendment 👇🏻

https://constitution.congress.gov/browse/essay/amdt11_1_3_2_2/

my hunch here is Bannon might zero in on the various immunities

I’m not convinced Bannon has a solid argument—which is why I noted the indictment was notable because in DC the USAO-DC can bring criminal charges in Fed District Court or Superior Court. The 11thA has implications on jurisdiction Fed v State but DC isn’t a state so that might be moot.

I’m really sorry for this long response. Your questions are excellent & I felt an obligation to expound more fully. Hope that makes sense
