I make zero apologies for my spicy sidebar. I’ve had a lot of time to think about it and I had first hand experience in the legislative and judicial trenches when my own State Assembly went 1956
Still reading and re-reading, but I’d like to suggest that a rectal sonogram using a a vaginal wand sheathed with a condom be part of the rectal exam. It’s much bigger than the doc’s index finger and the procedure could be justified by noting MD is looking for cancerous lumps.
Thank you for diving into the weeds of the Texas SCOTUS decision and explaining that it didn’t overturn Roe v Wade, which is what’s being reported. We know it’s a huge step in that direction though. C’mon Merrick Garland!!!
No joke I had many lobby meetings with my state assembly and I would occasionally say you want your limpness to go away - how the hell do you think women feel with a dolts legislate a mandate of a vaginal ultrasound …I’m not saying I’m 100% responsible for my state backing down -but in one meeting I showed up with walnuts and pecans and pulled out a nutcracker… the men were for a fleeting moment scared of me 😈😂😈
One of my bosses (the same one who showed me the real ludicrous mode) we, drove down together and on our way back he was like “kid your balls are bigger then mine” my response was with a straight face - “EEEEwww I was hungry and my Dr said nut protein are the best to stave off hunger pains”
that same year our client gifted me a fabulous nutcracker they commissioned from a craftsman in the Ukraine. And that nutcracker is the pride & joy of my holiday decorations— I should send you a picture because it’s freaking gorgeous
Bless your bellybutton! I love you for finding the time to write this for “us”. It helped bring down my stress level. Still angry as hell but a bit calmer. I love your sense of humor and greatly appreciate your insight and knowledge. Thank you!
Filey THANK YOU! for perfectly articulating everything that has been bouncing around in my head and I have been so pissed at the sheer ASSITUDE of these privileged white old men that think they have a right to govern women's bodies and control their little island of domination!
Always and I mean I’m always happy to help. I think that (rightfully so) emotions are running high but I felt like I could take the task of focusing on the facts and then explaining the complexity in layman’s terms. We aren’t out of the woods but I should remind folks that the 5thCCOAs isn’t as conservative as most think —they ruled against the Alabama anti-abortion bill in late 2019…I wish I could just retweet those threads because it contained a lot of research, but I can’t -so I figure I’d re-research and use this platform
Thanks for breaking this down. I am in no way less angry, but I am more hopeful. Also, these fuckers have poked a hornet's nest and may they pay for it. I also think that every man who wants to protect himself and his loved one should get a vasectomy and talk about why. And every other female in Texas needs to get access to birth control and condoms and never, ever drop their guard. This doesn't help the victims of abuse, but it will make them stand out.
Agreed -the zero exception for cases of rape and/or incest are egregious. This is why (remember my 2018 thru 2020 Judicial Crisis Network threads) yup here we are as previously predicted by Moi
Such a good question— the way I read the civil enforcement I don’t think the out of state abortion provider would be liable but if you read the analysis then any Texan that “aided and abetted” would apparently face civil liability—which is why I said TX-SB8 is the Frankenstein of all Frankenstein Anti-abortion bills to be codified by any state in the Union…see pages 4 thru 6 -specifically this subsection
Sec. 171.208. CIVIL LIABILITY FOR VIOLATION OR AIDING OR ABETTING VIOLATION. (a) Authorizes any person, other than an officer or employee of a state or local governmental entity in this state, to bring a civil action against any person
Thank you. You confirmed what I was thinking, that a proper lawsuit/legal action is needed to address it. Just what little I have read (not a legal person, just a nerdy engineer), there seems to be a lot of questionable issues with this bill. Among other things, since it seems to base its restrictions on fetal heartbeat, what if there is no heartbeat at say 10 weeks, 12 weeks?
Excellent questions - regarding the heartbeat - I’m not a medical expert. If you notice in the text of Texas SB8 they repeatedly used this specific phrase;
“…can be detected at six weeks”
I found this recent NPR article pretty informative re the fetal heartbeat
The Texas SB-8 is the Frankenstein of all Frankensteins - at last count three State of Texas Courts have recently issued TROs.
The biggest issue (in my opinion) is the civil liability and essentially deputizing any Texan to sue with a payout incentive of $10K. And the six year SOL meaning let’s say your ex-boyfriend, partner or husband thinks you had an abortion he (based on TX SB8) can sue you and others that “aided and abetted” and to essentially bankrupt lawful abortion providers. It’s a disgusting piece of legislation that should have never been codified
Yes, the civil liability issue is a gigantic mess, IMO. And where does HIPPA (sp?) privacy protections fit in all of this? One of the reasons I bring up the heart beat issue in particular is (as a parent of kid with Down Syndrome who lives in disability world and has encountered all sorts of issues in various settings), the issue of genetic anomaly doesn't seem to factor in. There are cases of say Trisomy 13 and 18 which is essentially unviable. If the fetus survives to a live birth, it will die shortly after (and painfully). Along with other conditions in which the fetus essentially dies in utero. There seems to be no factoring for preservation of the mother's life.
Absolutely fair points - and I respect your input even if I don’t entirely agree -but as you know I welcome various POVs —I think it makes us better thinkers and better researchers

To every f*ing word of parity testing for men when they want their ED meds.

"How. Fucking. Dare. You." Indeed.
If the woman goes to an out of Texas abortion provider, is that entity at risk too?
