Criminal Process specifically US Capitol Insurrection;
It occurred to me that some of you might not know the various acronyms typically used in case info (see the bates heading in various court filings). And some might not know the actual process of Criminal proceedings. Particularly for “out of district” cases. To help you to better navigate and understand the 214+ US Capitol Criminal Cases, the originating jurisdiction/district is Washington DC. Brief glossary of acronyms:
“USAO_xx” is an acronym for United States Attorneys Office, see DOJ Map
”MJ” case is an acronym used by the DOJ and Courts for Magistrate Judge
“CR” case is an acronym for Criminal Case
”SW” cases is an acronym typically for Search and Seizure Warrant
”GJ” cases is an acronym for Grand Jury
Investigatory and Judicial Process:
a crime is committed, a defendant is identified, law enforcement carries out an investigation (finding and collecting evidence, witnesses, etc). Investigators follow where the facts lead them.1
If enough facts are collected, investigators then work with the USAO and request a search warrant but again the threshold is “probable cause” - investigators then submit an affidavit (an affiant is the officer, an affidavit is a document presented to a Judge) 2
a search and seizure warrant can be executed after the defendant is in custody
Criminal Complaint versus Criminal Indictment;
A criminal complaint includes the Defendant(s) name(s), a list of allege crimes committed and an affidavit which requires a showing of probable cause that the defendant(s) committed the offense. A preliminary hearing occurs and the Government must show; 1) probable cause that the offense was committed; 2) confirm the identity of the defendant is accurate (sometimes the defendant waives this hearing, and 3) a preliminary detention hearing3
In the US Capitol Criminal Cases4. Following arrests, or in some cases a defendant will self surrender; defendants must appear before district court magistrate/judge where the arrest took place (pursuant to the Federal Rules of Criminal Procedure5 6 and only then the defendant is removed from that District to the District of Columbia.
Defendants DDC Case No: 1:21-cr-00035
I previously explained why PreTrial Detention Motion as to Defendant Michael LOPATIC was significant. Accordingly I’d like to elaborate on why this case is of greater significance. To date the only publicly available court document as to Defendant LOPATIC is the Feb 9, 2021 Government Pretrial Detention Memo (unsealed on Feb 12, 2021). Since Twitter tango’d down my account I realized that I had previously tweeted multiple threads on this particular case.
To reiterate I’d like to remind you of page 3, the second paragraph. In the Government’s Pretrial Detention Memo. Prosecutors provided incredibly disturbing details surrounding the assault on two Law Enforcement Officers “B.M” and C.M”
Defendant # 2 -Peter Stager

Stager was Arrested on 1/14/21 in Arkansas without incident.

As page 2 of the Affidavit notes, on Jan 6, 2021, between 4PM to 5PM Officer B.M. was on duty. He was stationed at an archway to a tunnel entrance to the Capitol. Full disclosure in the picture below I added the blue arrow because the “blue circle” can easily be overlooked to the untrained eye…again that arrow is not in the affidavit.
Prosector disclosed on Jan 12, 2021 the FBI received an electronic tip from a confidential source of information (CSI). The CSI stated that they recognized Peter Stager from a widely shared Twitter Thread, which included two videos of the violent insurrectionist.
…individuals grabbed B.M. and dragged him down the stairs of the Capitol building. These individuals forced B.M. into a prone position on the stairs and proceeded to forcibly and repeatedly strike B.M. in the head and body with various objects.
The Twitter Thread, included videos, which depict STAGER climbing the stairs, and holding a flagpole with a United States flag affixed to it. He used that pole to repeatedly hit officer B.M. who was in a prone position on the steps of the U.S. Capitol building. Thereafter CSI-1 contacted a second individual who informed CSI-1 that he/she had spoken to Stager via telephone on Jan 6th. During this telephone call Stager admitted he was at the Capitol and he used a flag pole to beat someone.
At which point CSI-2 disclosed to CSI-1 that they had previously sent a tip about Stager to the FBI. Shortly thereafter the FBI conducted a telephonic interview of CSI-2. During this interview CSI-2 informed the Agents during the Jan 6th telephone call with Stager, he brazenly stated he didn’t know he was beating a law enforcement officer (red circle is mine)
“…did not know the man he was striking on the ground with the flagpole was a cop and that he thought the person he was striking was ANTIFA…”
Defendant # 3 -Jeffrey Sabol
SDNY MJ Case No: 7:21-mj-00866, DDC MJ Case No: 1:21-mj-00077, and DDC Criminal Case No: 1:21-cr-00035.
Charge(s): Civil Disorder, Sabol was Arrested and taken into Federal Custody on 1/27/21 in the SDNY- I would expect Sabol’s indictment will include additional charges.

Prosectors allege that Defendant Sabol was later identified as part of the violent mob that dragged Officer B.M. down the stairs of the Capitol and then viciously attacked Officer B.M. - it wasn’t until I read the affidavit did I realize that Defendant Sabol used Officer B.M.’s own baton and held it on the officer’s lower neck and Defendant Sabol using his other hand pinned Officer B.M. down to the ground so other Insurrectionist could beat him.
In the minutes preceding the picture depicted above, Prosector disclose that Sabol is on video and he is seen seen running up the stairs of the Capitol and attempting to grab the leg of a presumed police officer (my educated guess is this officer is “Officer C..M.” who was trying to get to fellow Officer B.M. which is detailed in excruciating particularity in the Government’s Pretrial Detention as to Defendant LOPATIC, see pages 3 through 5).
After initially failing Sabol made a second attempt - charging back up the stairs and successfully grabs Officer B.M., pulling the officer down the stairs. All while punching officer B.M. in the back, at which point Trump’s Mob then begins to mercilessly beat him. Officer B.M. spent a week in the hospital recovering from the wounds he sustained during this violent attack. Fair warning this WUSA9 Jan 11, 2021 video is extremely difficult to watch.
The Affidavit details the events of Jan 11, 2021. Officers from the Clarkstown Police Department (CTPD) responded to a call of an erratic driver in New City, NY. CTPD found Defendant Sabol;
covered in blood, suffering from severe lacerations to both thighs and arms. While officers aided SABOL, he made several spontaneous statements to include but not limited to: “I am tired, I am done fighting”, “My wounds are self-inflicted”, I was “fighting tyranny in the DC Capital”, “I am wanted by the FBI”.
Sabol then proceeded to lie to Law Enforcement as they interviewed him from the hospital, he was admitted after police took him into custody following the traffic stop.
And now the moment you have waited for. Incidentally this largely explains the first three paragraphs of this article.
