Two US CAPITOL Officers sue Donald J Trump for his incitement of the deadly Jan6th insurrection
James Blassingame and Sidney Hemby have a combined twenty eight years of service. I hope a jury awards them tens of millions of dollars and Trump is sued into financial insolvency.
First off - I’m not going to dox these two US Capitol Police Officers and any mainstream media organization that does NOT redact these Officers home address are completely irresponsible. And yes Federal Court records are a matter of public information but again I do not want to participate in doxing these officers. They and their fellow officers have already endured so much.
Filed in District of District of Columbia Federal Court, it’s a civil lawsuit via ECF one thing you should know about a civil complaint is discovery will be brutal. If you think this is a money grab - then I’d like you to understand why civil complaints are filed… this is a path for plaintiffs to receive compensation for injuries sustained.
Plaintiffs:
PFC James Blassingame is a 17-year veteran of the United States Capitol Police (USCP). PFC Sidney Hemby is an 11-year veteran of the USCP.
I am going to warn you - this is a very difficult complaint to read -because both of these Officers (and their fellow Law Enforcement Officers) endured not minutes but hours and I mean many hours of both verbal and physical abuse. The impact of PTSD can not be emphasized enough. As you’ll note in paragraph 7 - it lays bare the causation and result of Trump’s “BIG LIE” -which is written and substantiated in the hundreds of pages of over 339+ current criminal cases;
The insurrectionists were spurred on by Trump’s conduct over many months in getting his followers to believe his false allegation that he was about to be forced out of the White House because of massive election fraud by his presidential adversary Joe Biden, and that the convening of Congress on January 6 to count the Electoral College results and declare the winner was their last chance to “stop the steal.”
Remember that thread where I explained what would happen - where I walked you through the December 14th and January 6th - to wit most of Twitter was like STFU - yes those were super fun times being harassed and trolled for simply saying: “look I’ve researched this eight ways to Sunday and my murder board keeps bringing me back to Trump doing something on January 6th and all hell brakes loose in the Joint Session of Congress” - yup super fun times…back to the civil complaint - now this is a very interesting argument - torts kids torts.
Oh dear Donald - oh dear me… good luck trying to S-L-A-P-P this complaint down - because we all know you’re going to argue the following, in no particular order of likelihood of success or precedence;
District of Columbia Anti-SLAPP Act of 2010, D.C. Code 16-5502
“Maaah free speech” or “but…but… your honor they are ganging up on me - I’m the actual victim” (classic narcissist pivot for small minded abusers) or “speech and debate clause” <—dear Gawd I know you’re going to play that specious card because you’ve tried it before - you dimwitted intellectually stunted hate goblin that clause is strictly for members of congress - you lack of understanding basic and I mean B-A-S-I-C third grade civics is adorable.
Trump’s Conduct Leading Up To the 2020 Presidential Election
The plaintiffs then point to the September 2020 Debate - and then lay down the Proud Boys Card with exquisite authority. Because these are not opinion - the facts born out in the hundreds of criminal cases, that the Proud Boys took a leadership role on the deadly insurrection.
Even after Twitter nuked Trump’s account his tweets are featured albeit less prominently but nonetheless still featured in the current complaint. What is really important here is how the plaintiffs are constructing a solid foundation of Trump’s onerous actions and inactions. The plaintiffs highlight that Trump’s constant drum-beat of dangerous lies resulted in dozens of protest occurring in various State Capitols all over our Country. Noting in some of the “stop the steal” protest many of Trump’s supporters showed up armed to the teeth and ultimately in Washington DC there were two protest which resulted in many law enforcement officers being physically injured. This is what we call “laying a foundational factual predicate”… and it’s refreshing to read such a well crafted complaint.
For reference (and I personally think this was a very smart move) the plaintiffs go in to detail about the two previous “MAGA” Washington DC rally;
November 14, violence erupted, as four police officers were injured and over twenty-one arrests were made, including destruction of property, carrying a pistol without a license, inciting violence, and disorderly conduct.
December “Million MAGA March,” and Trump followers clashed with D.C. police, at least eight of whom were injured. Four people were stabbed. The police made over thirty arrests including ten arrests for assault on a police officer, eleven arrests for simple assault, one arrest for assault with a deadly weapon, and two arrests for possession of a prohibited weapon.
All of that data in the complaint is actually supported by the MPD Unrest-Related Arrest Data Set - On January 6, 2021 Officers Blassingame and Hemby reported for duty - and both officers noted that their observations that at 5AM this crowd seemed to be different.
What didn’t occur to me is the US Capitol Police Officers, Metropolitan Police Department Officers and “traffic units” of the National Guard all heard the speeches from the rally -see pages 14 & 15 of the Complaint. Imagine if you will being a police officer, you report to duty, no roll call and then you can physically see how large the crowd is - all while listening to Giuliani and Trump and Brooks whip up the MAGA-QANON crowd into a frenzy
NEW DETAIL RNC & DNC pipe bombs
The Plaintiffs disclose, that while Trump was speaking, at 12:49PM US Capitol Police responded to a report of a possible explosive device at the RNC HQ - the device was later identified as a pipe bomb. Then a second pipe bomb was found at the DNC HQ -at the time I distinctly remember tweeting out why this was important and I tweeted a map because I understood most of my Twitter followers might not understand the actual geography. Both the RNC and DNC less than three blocks from the Capitol. At the time I genuinely tried to explain to my readers that the pipe bombs were undoubtedly a premeditated plan to create a diversion and to lure more US Capitol police away from the Capitol.
THERE IT IS - if you recall as the complaints were unsealed one fact that bothered me was, people falsely stated the attack occurred after Trump’s speech. And as more Complaints and Affidavit were unsealed I consistently noted that the “timeframe”.was moving from 2PM to 1:45PM and most recently pointed out that the Proud Boys breached the outer perimeter shortly before 1PM. The importance of that is - the perimeter was breached while Trump was still speaking
HOLY SHITTLESTIX that’s new - the plaintiffs allege that about 40% of the phones near the Mall - were later identified either inside the Capitol or on the Capitol complex grounds.
1:30 p.m., on the West Front of the Capitol, Capitol Police officers were forced by insurrectionists to the top of the Capitol steps. Meantime, Trump’s speech had ended, and many more thousands of protesters began marching toward the Capitol. About 40 percent of the phones tracked near the rally stage on the National Mall during the speeches were found in and around the Capitol during the insurrection, showing that many of those who …were listening to Trump’s speech followed his direction to march on the Capitol.
I think one of the more disturbing facts in this Complaint is the Plaintiffs had to watch their fellow officers being pinned down by Trump’s Mob. I can’t even comprehend what that must do on a person’s psyche seeing your fellow law enforcement officers trapped and being mercilessly beaten by an out of control mob.
♦️Trigger warning♦️—the next part of the complaint is incredibly difficult to read, this includes first hand accounts of what these two US Capitol Officers and their fellow officers endured. Again this is incredibly difficult to read.
Officer Hemby was crushed against the doors… Over and over, he tried to tell the insurrectionists that the doors opened outward and that pressing him into the door would do no good…the insurrectionists continued to scream, “Fight for Trump,” “Stop the Steal,” and various other slogans, as they struck him with their fists and whatever they had in their hands. Things were being thrown at him, and he was sprayed with chemicals that irritated his eyes, skin, and throat.
Officer Hemby continued to man his post at the top of the Rotunda steps outside the East Front of the Capitol…demanding that Officer Hemby and his fellow officers get out of the way so the mob could get to the Congress members…Officer Hemby and his fellow officers stood their ground… Officer Hemby was attacked relentlessly. He was bleeding from a cut located less than an inch from his eye. He had cuts and abrasions on his face and hands and his body was pinned against a large metal door, fending off attacks.
This is absolutely horrifying and unbelievably maddening - this is not okay - no one and I mean no one …especially law enforcement deserves this kind of physical and verbal abuse. I am disgusted by Trump and his radicalized violent mob.
…the terrifying certainty that the insurrectionists were interested in him and the other officers not going home to their families that night…. Then a forceful surge of insurrectionists pushed forward and slammed Officer Blassingame against a stone column. He struck his spine and the back of his head and was unable to move. …For the first time in his life, people were yelling into his face, calling him a “nigger” repeatedly and throughout the attack in the Crypt. He lost count of the many times the racial slur was hurled at him.
insurrectionists struck Officer Blassingame in his face, head, chest, arms, and what felt like every part of his body. Insurrectionists used their fists and had weapons that ranged from flagpoles to stanchions and building directional signs, water bottles and other objects he could not identify.
I uploaded the newly filed civil complaint to my public drive. I genuinely hope Trump is sued into financial insolvency. What these officers went through, what they are still dealing with and that of their fellow officers. Donald J. Trump needs to pay a very hefty price for his reckless and horrifying actions. Seven Americans died, three of whom were law enforcement. 140+ officers sustained severe injuries. Trump needs to be financially liable for the injuries he caused.
Thank you Filey. You are doing such a service explaining this to us. I'm hopeful for justice yet again.
This is why I want Traitor Trump & the Trump Crime Family along with the rest of their evil cabal to die broke & alone in prison. This makes me so angry I could chew nails. This is APPALLING!! I'm particularly hurt & enraged by their fears of not making it home alive, because we know that some of their comrades did NOT make it out alive. Their fears were not unfounded. Some gave all in the line of duty. May God bless these officers & their comrades, alive & deceased, who did their best to protect the Capitol & everybody in it that day.
