The absurdity that Russia is the current President of the UN Security Council 1isn’t just egregious, it act actually shock the conscience… leaving the vast majority of the world with the view that Russia’s Aggressive declaration of war, is grossly unjust to a casual observer… It is absolutely shameful that the United Nations Security Council has failed to remove the current President.

In a rare form of a diplomatic protest - during Russia’s speech at the U.N - U.S., European and British diplomats walked out of a speech by Russian Foreign Minister Sergei Lavrov to the top U.N. human rights forum, in protest on Russia's attacks on Ukraine. In stark contrast Ukrainian President Zelenskyy received at standing ovation at the conclusion of his March 1, 2022 address to the United Nations General Assembly’s emergency meeting.
And some might already know this, but on February 26, 2022 the UN Office for the Coordination of Humanitarian Affairs (OCHA) reported
“at least 240 civilian casualties, including at least 64 dead” as of February 26. Additionally, infrastructure damages has forced the internal displacement of at least 160,000 people and caused at least 116,000 people to flee across an international border… the report estimates that Russia’s invasion could generate 5 million refugees in the “worst-case scenario.” Several specific attacks have raised allegations of warm crimes.
International Criminal Court (ICC)

Feb 28, 2022 ICC Prosecutor Opens investigation:
One thing to keep in mind, the ICC had previously found that Russia committed war crimes and crimes against humanity during their unlawful invasion of Ukraine’s Crimea territory and the Russia’s unlawful annexation, see below for the two previous declarations…
On April 9, 2021 the Government of Ukraine sent their first declaration, thereafter the ICC accepted jurisdiction to the crimes Russia committed on/in the Ukrainian territory (of Crimea) —these events too place on November 21, 2013 thru February 22, 2014
On September 8, 2015 the Government of Ukraine submitted their second declaration, which extended the time period of the investigation to an open-ended basis. Ukraine further elaborated on the ongoing crimes to encompass ongoing alleged crimes committed throughout the territory of Ukraine from February 20, 2014 to sine die
In late December of 2020 the ICC released a 74 page preliminary report 3 (found here)
This back in April of 2020 I created this (archived) Twitter thread because at the time the State Department’s press conference transcript —made my ears perk up. Unfortunately as of now I’ve been unable to locate any archive of the ICC and UNHCR twitter threads, specifically the ICC hearing and testimony from both Ukraine and Russia. February 28, 2022 Statement of ICC Prosecutor, Karim A.A. Khan QC, on the Situation in Ukraine: “I have decided to proceed with opening an investigation.” Because the ICC has two active investigations in to Russia’s previous War Crimes —in their unlawful invasion of Crimea and equally unlawful annexation of Crimea. In simpler terms, the previous formalities and process are unquestionably truncated, as noted by the ICC Prosecutor, the February 2022 unlawful full invasion of Ukraine by Russia —his office is rolling the 2022 Russia’s war against Ukraine into an ongoing investigation…
…there is a reasonable basis to proceed with opening an investigation… I am satisfied that there is a reasonable basis to believe that both alleged war crimes and crimes against humanity have been committed in Ukraine in relation to the events already assessed during the preliminary examination by the Office. Given the expansion of the conflict in recent days, it is my intention that this investigation will also encompass any new alleged crimes falling within the jurisdiction of my Office that are committed by any party to the conflict on any part of the territory of Ukraine.
How does the UN define war crimes;
It’s important to fully understand what constitutes “war crimes” versus “crimes against humanity” and how governing bodies like the United Nations, are bound by previously ratified treaties and conventions. You can read more via this United Nations links:
War Crimes in layman’s terms and broadly speaking, killing innocent individuals, bombing the ___ out of Schools, Hospitals, Homes, Apartment Buildings —essentially indiscriminate bombing. You have probably already heard the phrase “collateral deaths” those are civilian deaths.
…the intentionally killing civilians or intentionally killing prisoners of war, torture, taking hostages, unnecessarily destroying civilian proper
…notably the four 1949 Geneva Conventions and the two 1977 clearly articulate the rules of engagement.
First Geneva Convention of circa 1864
Second Geneva Convention, circa 1949 -protects wounded, sick and shipwrecked military personnel at sea during war
Third Geneva Convention, circa 1949 -which applies to prisoners of war.
Fourth Geneva Convention affords protection to civilians, including in occupied territory.
Protocol I of the Geneva Convention —which is specifically for international armed conflicts and protected persons
Protocol II of the Geneva Convention —Protection of Victims of Non-International Armed Conflicts
Protocol III to the Geneva Conventions -circa 2005
As further defined via the Rome Statute of the International Criminal Court
Rome Statute - Article 8 -War Crimes
The Court shall have jurisdiction in respect of war crimes in particular when committed as part of a plan or policy or as part of a large-scale commission of such crimes.
For the purpose of this Statute, ‘war crimes’ means:
Grave breaches of the Geneva Conventions of 12 August 1949, namely, any of the following acts against persons or property protected under the provisions of the relevant Geneva Convention:
the Willful killing
Torture or inhuman treatment, including biological experiments;
Willfully causing great suffering, or serious injury to body or health;
Extensive destruction and appropriation of property, not justified by military necessity and carried out unlawfully and wantonly;
Compelling a prisoner of war or other protected person to serve in the forces of a hostile Power;
Wilfully depriving a prisoner of war or other protected person of the rights of fair and regular trial;
Unlawful deportation or transfer or unlawful confinement;
Taking of hostages.
Some might be wondering whether or not; is Russia a “state party” to the Geneva Convention —the short answer is yes and no —mainly because Putin is a small man, a murderous thug. Putin does what he wants. When he wants because until February 2022 Putin acts with bear impunity. The entire kerfuffle over Herr-Fuhre-Putin activating Russia’s Nuclear Forces on high alert.

I would have liked to have completed better research but I’m under tight time constraints and I only had a few moments during lunch to publish this article (which I started writing on February 27 2022) —again I apologize for the less than thorough writing but I did set your expectations that I would return to publishing on March 1, 2022. The ICC’s defines their…”preliminary examination of a situation by the Office may be initiated on the basis of: (i) information sent by individuals or groups, States, intergovernmental or non-governmental organisations; (ii) a referral from a State Party or the United Nations (“UN”) Security Council; or (iii) a declaration lodged by a State accepting the exercise of jurisdiction by the Court pursuant to article 12(3) of the Statute…”
