Legislative Background
H.R. 3106 Domestic and International Terrorism DATA Act
(DT DATA Act)
June 5, 2019, Chairman Thompson introduced H.R. 3106, the Domestic Terrorism Documentation and Analysis of Threats in America Act, or the DT DATA Act, to foster transparency surrounding domestic terrorism data and increase research on the issue with domestic terrorism attacks clearly on the rise. The bipartisan piece of legislation passed the House of Representatives, as amended, on September 26, 2019.
Additionally DT DATA ACT required;
Require FBI, DOJ, and DHS to produce an unclassified yearly report with: data on domestic terrorist incidents; assessments, investigations, indictments, prosecutions, and convictions with a domestic terrorism nexus; and the number of DOJ and DHS full-time staff working on domestic terrorism.
Require GAO to audit the annual report.
Require DHS to study transnational links between groups linked to domestic terrorism in the U.S., such as white supremacists, and their counterparts abroad.
NATIONAL DEFENSE AUTHORIZATION ACT (NDAA) FOR FISCAL YEAR 2020 -PUBLIC LAW 116–92
DOMESTIC TERRORISM GOVERNMENT REPORT PROVISION INCLUDED IN BIPARTISAN NDAA, which was largely promulgated by H.R.3106
Section 5602 of the NDAA-FY2020 1directs the FBI, Department of Homeland Security, and the Office of the Director of National Intelligence to produce a joint intelligence assessment and data driven unclassified report on domestic terrorism.
It must include data on domestic terrorist incidents; assessments, investigations, indictments, prosecutions, and convictions with a domestic terrorism nexus; and the number of DOJ and DHS full-time staff working on domestic terrorism. While balancing additional privacy, civil rights, and civil liberties protections, and to ensure data quality.
Measures necessary to ensure the protection of privacy and civil liberties in the carrying out of activities relating to countering domestic terrorism.
Notably the data, analysis, retention and other mitigating factors that could impact the integrity of said data collection.
(A) DATA REQUIRED.—In accordance with subparagraph (B), the report under paragraph (1) shall include the following data for the period beginning on January 1, 2009, and ending on the date of the enactment of this Act…
(I) an identification of each assessment, preliminary investigation, full investigation, and enterprise investigation with a nexus to domestic terrorism opened, pending, or closed by the Federal Bureau of Investigation;
(II) the number of assessments or investigations identified under subclause (I) associated with each domestic terrorism investigative classification (including subcategories);
The Trump administration contempt for laws
The NDAA-FY2020 required (“shall” is declarative and not optional) the Administration, specifically the DOJ and DHS which are both under the executive branch to submit the statutorily require reports to Congress. The Trump Administration failed to do so, as prescribed by PUBLIC LAW 116–92—DEC. 20, 2019.
Accordingly House Homeland Security Committee Chairman Thompson, along with Subcommittee on Intelligence and Counterterrorism Chairwoman Elissa Slotkin and leadership from the House Permanent Select Committee on Intelligence and the Committee on the Judiciary, sent a letter to President Biden this March urging him to expedite the production of this critical report. On May 14, 2021 the FBI and DHS (finally) published the (long awaited)

US Code at 18 U.S.C. § 2331(5) 2 - which defines domestic terrorism as:
Involving acts dangerous to human life that are a violation of the criminal laws of the United States or of any State;
•Appearing to be intended to:
Intimidate or coerce a civilian population;
Influence the policy of government by intimidation or coercion; or
Affect the conduct of a government by mass destruction, assassination or kidnapping
Occurring primarily within the territorial jurisdiction of the United States
…use the words “violent extremism” to define DT threats because mere advocacy of political or social positions, political activism, use of strong rhetoric, or generalized philosophic embrace of violent tactics may not constitute violent extremism, and may be constitutionally protected…
Under FBI policy and federal law, no investigative activity may be based solely on First Amendment activity, or the apparent or actual race, ethnicity, national origin, religion, gender, sexual orientation, or gender identity of the individual or group. The FBI does not investigate, collect, or maintain information on US persons solely for the purpose of monitoring activities protected by the First Amendment.
Strategic Intelligence Assessment 2019
This report is, by law required unclassified. Meaning everyday Americans, like you and me can understand what the FBI and DHS are monitoring, tracking and other proactive measure to address the growing Domestic Terrorism Threat. Because, after all an informed voter is a better voter and better citizen.
The year 2019 represented the most lethal year for DVE attacks since 1995, with five separate DVE attacks resulting in 32 deaths, 24 of which occurred during attacks conducted by RMVEs advocating for the superiority of the white race.

I could be mistaken - but on information and belief I think this is the first time the FBI has publicly provided this level of detail when opening a domestic terror investigation. See page 10 of the May 14th FBI/DHS Report to Congress;
No investigation may be opened based solely on activities protected by the First Amendment or the lawful exercise of rights secured by the Constitution or laws of the United States.
The opening of a preliminary or full investigation classified as a DT matter must be approved by the Field Office’s CDC; however, the opening of a full investigation classified as an IT matter does not have the same requirement….
…Attorney General’s Guidelines for Domestic FBI Operations (AGG-Dom) authorize all lawful investigative methods in the conduct of a full investigation. The FBI requires file reviews of full investigations every 90 days.
A Supervisory Special Agent must approve the closure of both full and preliminary investigations. A preliminary investigation must be closed within six months of its opening but may be extended for an additional six months.

One thing to keep in mind - the data in the joint FBI & DHS report doesn’t include data for 2020 to present. In March 2021 FBI Dir Wray testified (I embedded several videos of Dir Wray’s testimony and a link to his written statement in that March 2, 2021 article)
As a refresher Dir Wray testified that Capitol insurrection is part of a persistent domestic threat. Citing about 2,000 current investigations which is approximately double the number the FBI reported just four years ago.
Director Wray also quantified how the growing threat of domestic terrorism continued to be a top priority for the FBI. Wray also indicated "racially motivated violent extremism" tied to white supremacists is the "biggest chunk" of the FBI's domestic terrorism portfolio.
Past Data regarding DVEs
FY 2015 -211 DT subjects were arrested, with 130 subjects charged federally and 81 subjects charged with state/local charges.
FY 2016 -229 DT subjects were arrested, with 169 subjects charged federally and 60 subjects charged with state/local charges.
FY 2017 -186 DT subjects were arrested, with 109 subjects charged federally and 77 subjects charged with state/local charges.
FY 2018 -113 DT subjects were arrested, with 54 subjects charged federally, 52 subjects charged with state/local charges, and seven subjects charged with both federal and state/local charges.
FY 2019 - 107 DT subjects were arrested, with 63 subjects charged federally, 42 subjects charged with state/local charges, and two subjects charged with both federal and state/local charges.

I ran a general search and beyond the initial <24 tweets I didn’t see any deep dives (threads) or detailed reporting by the MSM into this publicly released report. Also super weird how disinformation QANON-for-the-Left Faux-Intelligence-Community Accounts didn’t even know this report was publicly late last Friday. Now you have a deeper understanding & pertinent data from the report.
