Defendant JEFFREY MCKELLOP charged with;

18 U.S.C. § 111(a)(1), (b)- Assaulting, Resisting, or Impeding Certain Officers with a Deadly or Dangerous Weapon, 18 U.S.C. § 231(a)(3)- Obstruction of Law Enforcement During Civil Disorder, 40 U.S.C. § 5104(e)(2)- Violent Entry and Disorderly Conduct on Capitol Grounds, 18 U.S.C. § 1752(a)(1), (b)(1)(A)- Knowingly Entering or Remaining in any Restricted Building or Grounds Without Lawful Authority With a Deadly or Dangerous Weapon, 18 U.S.C. § 1752(a)(2), (b)(1)(A)- Disorderly and Disruptive Conduct in a Restricted Building or Grounds, with a Deadly or Dangerous Weapon, 18 U.S.C. § 1752(a)(4), (b)(1)(A)- Engaging in Physical Violence in a Restricted Building or Grounds, with a Deadly or Dangerous Weapon.

The affidavit states that MCKELLOP repeatedly assaulted numerous law enforcement officers. The evidence includes at least four different Body Worn Cameras. Providing many different angles of the defendant assaulting Law Enforcement.

In the affidavit - the FBI Agent made the following disclosure and it’s kind of interesting and vexing. Why would Defendant wear the National Flag for the Country of Georgia?

“…affiant, conferring with other law enforcement personnel, observed the unique red and white patch located on the chest area of this individual’s ballistic armor. Your affiant has identified this patch to be the national flag of the country of Georgia…”

Shortly after the FBI issued the BOLO -which contained four pictures (FBI BOLO #215A, FBI BOLO #215B, FBI BOLO #215C and FBI BOLO #215D) they receive two tips from two individuals. Both of whom had previously served with Defendant MCKELLOP. And both of whom told the FBI that MCKELLOP was a retired US Army Special Forces Solider.

“…Witness 1 knew MCKELLOP from in-person contact for approximately 6 years and described him as a retired U.S. Army Special Forces soldier and a military contractor who, at times, works overseas, and resides in Fishersville, Virginia, which is located near Staunton, Virginia…. Witness 2 stated that MCKELLOP was a retired U.S. Army Special Forces soldier with whom Witness 2 served from 2001 to 2016. Witness 2 further stated in the tip that MCKELLOP was a military contractor and that Witness 2 last saw MCKELLOP overseas in 2018”

To help you to understand just how violent and hellbent MCKELLOP was - based on the time/dates proffered in the affidavit- it appears that the Defendant engaged in a protracted physical combat with law enforcement. Remember that body worn cameras are meant to store/capture long periods of time. Note the time/date cited on page 10…put a pin in that -I’ll come back to it later (because I think it’s important)

“….approximately 1:14pm, MCKELLOP moved closer to the Capitol Building, at which time he was captured on an MPD BWC video (Figure 16). I also observed that MCKELLOP put on a helmet and a gas mask, which match the helmet and gas mask seen in Figure 2 through Figure 4. These are also the items which Witness 2 described as MCKELLOP’S military kit”

Remember how I said that the time/date stamps are kind of important? Well if you recall the Proud Boys cases - the Government backed the time from 2PM to 1:45PM to 1:25PM to 1:01PM and then most recently the timeframe is now closer to 12:49PM (see previous article - specifically paragraph 49 et seq) - in the 1st Body Worn Camera (BWC) the Government states 13:14:23 - yet the last time/date stamp in the affidavit is 14:18:49 - so a reasonable conclusion is the Defendant spent a better part of an hour fighting and retreating.

The conduct of Mr. McKellop is gravely troubling. The Government shows him on video thrice making violent physical contact with law enforcement. The last incident of violence is particularly troubling as he wields a flag-pole and attempts to spear officers with it.

…But as a person who has taken an oath to defend the Constitution and with high-level security clearance, Mr. McKellop knew that his conduct was forbidden and that attacking the Capitol was a serious affront to our democracy….He abused his position of trust, which reflects negatively on his history and characteristics.

DOD Stand-Down to Address Extremism in the Ranks²

The Department of Defense Instruction (DoDI) 1325.06, " Handling Dissident and Protest Activities Among Members of the Armed Forces" provides the core tenets to support such discussions. Leaders have the discretion to tailor discussions with their personnel as appropriate, but such discussions should include the importance of our oath of office; a description of impermissible behaviors; and procedures for reporting suspected, or actual, extremist behaviors in accordance with the DoDI.

ProTip if you stab a law enforcement officer in the face, and still try to argue you’re a Veteran - no that’s not going to work; also having your friend Scott Steiert, also Special Forces veteran, submit a letter to the court that he invited you - that’s not exactly exculpatory evidence and your friend might now be an active Target of the every sprawling investigation.

As further elucidated in the Government’s Opposition to the defendant’s quest to be “released” - which reads in part (red circle is mine)

Magistrate Judge Faruqui noted in his ruling, this defendant’s actions are among the most egregious yet identified….After assaulting a line of officers, including attempting to grab the riot-control spray out of the hands of one officer, he offered them a universal symbol of disrespect—the middle finger (violent acts were committed unflinchingly and with marked disrespect for the law.

Enjoy Jail because you are a disgrace - yes I know all Defendants are afforded a presumption of innocence but FFS the Government proffered FOUR BWC footage of the Defendant assaulting law enforcement. So spars me the “you’re not being fair” —> sedition has consequences and this f__ker should be stripped of all military honors and so should his pension… sorry not sorry -that’s my line in the sand. -Filey
