The fraudulent canonization of Mike Pence et al & Senior Trump/Pence staffers…UPDATED with June 16th DOJ Court Filing

Trump’s inner circle had an oath, too. And they failed

Let me preface that most of my adult life I’ve bristled as the rush to canonize or say XYZ are heroes, for merely doing their job. And to be fair I’m less likely to be harshly critical of former Vice President Pence. As it relates to public policy and good governance for the people —Pence and I are on opposite sides of the political spectrum. The bottom line is, on January 6, 2021, while under enormous pressure, Mike Pence did his job. Pence remained loyal to his oath of office. Pence set aside his own personal ambitions and he did in fact put “Country First” but again he did his job and fulfilled his oath.

Therefore irrespective of my personal animus towards Mike Pence and his draconian public policy decisions, I can and in fact do respect the actions he took leading up to and on January 6, 2021 —conversely he gets zero accolades from me because he stood there in March 2020 and lied to the American people about COVID-19 and testing kits. Those lies cost tens of thousand of Americans their lives. And unquestionably contributed to the over one million Americans deaths, from COVID-19.

Under that factual framework I’d like to discuss those in Trump’s inner circle. Their betrayal of their oath of office. Their betrayal of the American people. Their betrayal to our Democracy

…below is the January 22, 2017 swearing in ceremony for Trump/Pence senior staffers. I want to you pay attention to who took that oath in 2017…

And yes, in February 2022 (former) VP Mike Pence finally spoke the truth during his Federalist Society Speech —keep in mind that was after nearly one full year of Pence excusing and hypocritically defending Trump’s big lie. I suppose better late than never.

If you haven’t watched her June 16, 2022 appearance on Jake Tapper’s the lead, I would recommend that you take a moment and listen to what she said, when she point blank addressed Ivanka Trump and Jared Kushner…

As you’ll note by Ms Garza’s comments, it is indeed a fact that Donald J Trump (and ostensibly no one from the Trump Administration) ever picked up the phone or sent a letter of condolence to Officer Sicknick’s family. A few days ago I provided the CNN interview of Officer Sicknick’s bothers, while explaining the “oath of office” —you can read more here —Moreover the Duke of Cambridge sent a partially handwritten letter to Officer Sicknick’s partner, Sandra Garza. The Duke of Cambridge’s letter is dated September 2021 and it reads in part:

“Please forgive me if I am intruding but I wanted to write and let you know how sorry I am about the death of your partner, Brian,… officer’s “patriotism and selflessness” throughout the “harrowing” attack on the US Capitol.

Again at no time did Trump, nor anyone within his administration make any effort to contact Officer Sicknick’s family. I suppose one could argue perhaps the guilt and shame was enough to rationalize the unbelievable disrespect Trump et al have/had for Officer Sicknick and the four other police officers, who later died by suicide and the countless officers who are still struggling with what they saw, heard and permanent injuries sustained during Trump’s deadly domestic terror attack, see July 27, 2021 article/videos here

Now I’d like to address Trump’s senior Administration Officials…not to belabor this point; each of them sworn an oath:

“…I will support and defend the Constitution of the United States against all enemies, foreign and domestic…”

In the weeks leading up to the deadly January 6, 2021 domestic terror attack, again I’m not using those words arbitrarily or captiously —in March 2021 FBI Director Wray, unambiguously stated the Jan6th attack was domestic terrorism. Whispers you can not win in debating me on this issue, my argument is impeachable…because those are facts, not opinions but actual facts.

Ivanka Trump and Jared Kushner were duty bound…

Let’s set aside the wholesale violation of 5 U.S. Code § 3110 - Employment of relatives; restrictions… which precluded them from serving in our Government, not the least of which in our White House. Both Ivanka Trump and Jared Kushner had a moral and ethical obligation to speak up before the deadly domestic terror attack. And while the HSCJ6 has done a masterful job of dragging Trump’s filth into the scorching sunlight.

I can not and will not accept the canonization of the VP, his staff and Trump’s daughter and son-in-law. On the latter I have completely different reasons. The HSCJ6 has made a damning presentment of facts.

Donald Trump & his adult children should be barred (for life) from holding any public office…

You are under zero obligation to take my word for it —in fact Judge Luttig’s closing comment that Donald Trump and those around him that enabled a deadly attack on our democracy are “a clear and present danger” to our shared Republic

During the June 16, 2022 HSCJ6 hearing, they presented a prolific amount of fact witnesses, direct testimony —all of them testified to the events going on inside the Trump White House:

• Mark Short testified he knew the Trump/Eastman plan was unlawful, Mark Short further testified that he had told Trump (and his staffers) that the VP lacked the power/authority to “steal the 2020 election” from the American people

• Eric Herschmann further testified that he had multiple conversation with both Eastman and Trump

• Greg Jacob live testimony concerning both Eastman and Trump’s unlawful conspiracy to defraud the American people. Explaining the Eastman/Trump theory was unlawful and a betrayal to our Country’s framers.

• retired Gen. Keith Kellogg’s video depo, that the Trump/Pence phone call Trump purportedly told Pence: “You’re not tough enough to make the call,” also see November 9, 2021 HSCJ6 letter to Gen Kellogg

• Ivanka Trump previously testified (see excerpts of her deposition here) -she also said the last Trump Pence call became “heated” other Pence staffers testified in their deposition that Trump called Pence “weak…and a pussy”

More than half a dozen of Trump and Pence staffers knew that the Eastman/Trump seditions conspiracy was unlawful —(apologies for yelling)

At no time on January 6, 2021 did they go public…

There are dozens of reporters and camera crews at the White House, hypothetically speaking if a Senior Trump or Pence staffer had held an “emergency press conference” that unquestionably there would have been dozens of TV cameras who would have broken away from regular programming to air said press conference.

The fact that Trump’s own daughter and son-“whining”-in-law both knew that the Eastman/Trump plan would lead to violence and instead remained silent. I’m sorry but I’m not okay with the fraudulent canonization of Pence, Trump’s Adult Children, Pence Senior Staffers and Trump’s Senior staffers all choose to remain silent.

That kind of betrayal of their oath of office can not and should not be overlooked. Conversely I understand why Pence’s attorneys did not speak publicly until June 16, 2022 —they are bound by the oath they took as Officers of the Court —but every other staffer that the HSCJ6 has deposed —there is zero excuse for their silence. Their silence cost the lives of numerous MAGA supporters, at least five police officers and it has shattered countless families across America.

Because those family members have turned in their own relatives. So you’ll have to pardon my acerbic sarcasm that some how Ivanka, Jared et al should be canonized. Their silence cost many Americans their lives on January 6, 2021 and the subsequent days that followed.

As many of my readers know, I’ve written extensively on John Eastman (see here) and for the umpteenth time I have never purported to be an attorney. I’m the one they turn to for research, (gleefully) playing devil’s advocate and then poking holes in the current argument. Notwithstanding here’s something you should know about attorneys, it’s an unspoken creed:

• Never do something that makes you lose your bar license

• Never be in a position to exercise your fifth amendment rights

• And never ever aid and abet in a conspiracy or furtherance of a conspiracy

• Never conduct yourself in a manner where a Court sanctions you

Over the weekend I plan on doing (my level of) research on post presidency fringe benefits. We are talking about millions of dollars in tax payer funded benefits. In the event the Department of Justice declines to prosecute both John Eastman and Donald Trump —well I’m going to present facts that Congress could and should act. Also I’m old enough to remember a certain PITA saying that the Senate Republicans who voted (twice) to acquit Trump should pay a hefty political price. Based on the HSCJ6 three hearings and facts presented to the American people, Congress has the power to claw back post presidency benefits… but as I previously stated the research is a hefty lift and I plan to publish the follow up article on Sunday —however here’s a tiny excerpt…

And of course your daily saltwater therapy —my grief counselor suggested that I go to my former boss’ grave. I went there yesterday and it was difficult but I definitely feel like I’m dealing with this grief far better than I was nearly eight weeks ago. Because shortly after exiting the cemetery a nearly pure white dove landed on my car and I looked up at the sky and told my former boss “look I’m not pissed at you anymore, I just feel bad that I didn’t see the signs and that the pain you were in was just too much, I get it. But fuck you for leaving me” and when I uttered the FU the dove flew off…

Again BOLO for a follow up article over the weekend. Thus far I’ve tracked down several GAO reports and other official Congressional records. Lastly I know that some are maintaining anger towards the HSCJ6 refusal to send the more than 1,000 deposition transcripts to the DOJ. So here are a few simple bullet points:

I don’t fault the HSCJ6 Committee from refusing to release the 1K+ transcripts. Here’s why:

• 1) leaks,

• 2) depo transcripts are the work product of HSCJ6,

• 3) the DOJ request occurred in March -a full 3 months before the Committee’s hearings, and

• 4) the HSCJ6 investigation is still very much ongoing.

At no time has the HSCJ6 stated they will not turn over the deposition transcripts. In fact the HSCJ6 has explicitly stated “when the time is right” (whispers I’m also pretty sure the Rules of Congress will require a full committee vote and then it’s transmitted to the Speaker of the House —which means the possibility of a floor debate and vote by the full House)

During the HSCJ6 June 16, 2022 bearding the DOJ filed the following in Criminal Case No 1:21-cr-00175 -Document No 404 & 404-1 see DDC ECF for:

For now it’s best to take the wait and see approach as to how the Court will rule on both the Defendant’s Motion to Continue and the DOJ’s Motion to compel production of the over 1,000 HSCJ6 deposition transcripts

Conversely what is the DOJ’s excuse for not producing the various 302s, multiple interagency communiques? Here’s something I know for a fact the DOJ did not want to hand over their materials concerning Jeffrey Clark because there are at least 2 separate criminal investigations (ongoing) as it relates to Clark. Whispers because the same reasons the HSCJ6 didn’t release the transcripts are in fact similar to why the DOJ denied the HSCJ6 request. Discuss amongst yourselves but I would urge caution in being mad at both the HSCJ6 and DOJ —I know you might get sick of me saying this but I genuinely mean it…

Be patient because our criminal Justice system is painfully slow —as are Congressional investigations.

As you know I’ve repeatedly stated that Americans have become conditioned to the “immediate satisfaction” or “I want it now” both of which are antithetical to the tenants of our criminal Justice system and more broadly Congress.

Until this weekend -be well and for the love of Nancy stop believing everything you read on Twitter (generally social media) because these are hyper echo chambers and are often detached from both facts and reality…because every time I read an uninformed prognostications on social media this is what runs on loop in my head…

PS —many of you might strenuously disagree with the next statement —the hoopla around Ginni Thompson I would urge you to be cautious because I’m fairly certain Ginni Thompson’s main argument will be (correctly) predicated on her first amendment right. Granted I’m open to the possibility that the HSCJ6 might uncover evidence that Ginni Thompson’s actions went beyond her “freedom of speech” but I remain skeptical that she purportedly funded the Jan6th domestic terror attack on our Capitol. But again I’m open to that possibly the fact is there’s nothing in the public domain to substantiate that rumor.
