Day 1 Trial Summary
“Dad, I don't want to come back to the Capitol.'"
In yesterday’s proceedings this is the moment that truly hit home. Just days before the Raskin family shared with the Nation, their unspeakable tragedy; their beloved son sadly had lost his battle with depression. House Lead Impeachment Manager Rep Raskin brought his family to the Capitol. And the trauma of Trump’s violent insurrection left an everlasting stain on our Country.
Impeachment is inherently political.
When you see/read the newly self appointed Twitter-Constitutional Impeachment experts, pontificate about “the process” and the in/outs of an impeachment. Do you ever wonder why these self appointed experts rarely provide you with documents or actual research. Clearly this does not apply to the actual Constitutional Experts or former Prosecutors, all of whom have the veritas and credentials to tweet/speak with actual subject matter authority.
This also bears repeating, an impeachment trial has two audiences; the Court of public opinion (that’s people like you and me) and the Senate. Each impeachment has unique procedures1 2An impeachment is not bound by the Federal Court’s Rules of Criminal Procedure you can find the Current Rules of Practice & Procedure, via the US Federal Court’s website.
Day 2 Summary:
The House Impeachment Managers spent much of their time carefully walking through the chain of events, with a heavy emphasis of Trump’s actions during and after the deadly insurrection. It was striking how lead impeachment manager Rep Raskin carefully reconstructed Trump’s actions. And notably drawing a stark contrast that Trump failed to rise to the “Consoler in Chief” to calm the Nation. Instead Trump did the exact opposite. He continued to praise his angry-mob and going as far as to say “you’re special and we love you”. The House Managers also entered this tweet into the record, note the time/date stamp. 3
The Violent-Mob believed that they were following Trump’s Orders, the House Impeachment Managers entered numerous videos. All are pretty damning and if you read the various criminal complaints - many of the Defendants specifically state: “the president invited us to the US Capitol” or “I was just doing what Trump ordered us to do” or “Trump is an un-indicted co-conspirator”
Rep Joaquin Castro’s Opening Argument - provided the “Big Lie” predicate. Which Trump and his surrogates with help from Fox News and other Extreme Right-Leaning “news” organization spent sixty (60) plus days post the November 2020 election, by saturating the airwaves and social media with Trump’s “big lie” but it was this statement that was the most devastating:
”The most combustible thing you can do in a democracy is convince people that an election doesn't count…especially if what you're saying are lies."
Rep. Jamie Raskin on Trump's rhetoric: "This case is much worse than someone who falsely shouts fire in a crowded theater. It's more like a case where the town fire chief who's paid to put out fires sends a mob — not to yell fire in a crowded theater but to actually set the theater on fire"3 see Brandenburg v. Ohio, 395 U.S. 444 (1969) and Schenck v. United States, 249 U.S. 47 (1919), which I provided to you yesterday, found here
Rep. Jamie Raskin: "Donald Trump surrendered his role as commander-in-chief, and became the inciter-in-chief of a dangerous insurrection….can our Country and Democracy ever be the same if we don’t hold the person who incited this violent attack”
Rep Joe Neguse “The evidence is clear, and it is overwhelming. He assembled the mob, summoned the mob, and incited the mob. He must be held accountable… think for just a moment of the lives lost that day...of the more than 140 wounded police officers and ask yourself ‘if as soon as this had started if President Trump had simply gone on to TV...just logged on to Twitter and just said ‘STOP the ATTACK’...if he had done so with just half the force of his “stop the steal’...how many lives would we have saved”
Rep Eric Swawell: “Donald Trump for months and months assembled the tinder, the kindling, threw on logs for fuel to have his supporters believe that the only way their victory would be lost was if it was stolen.”

Three Hours and Thirty Minutes
That is how long the House Impeachment Managers state that Donald Trump waited to do or say anything to his violent-mob in the insurrection he incited. Trump and his surrogates spent months feeding his base the “big lie”. In the months, weeks and days leading up to Trump’s deadly insurrection, he engaged in a protracted attack on our Democracy:

Fulton County District Attorney letters to state officials:
In a letter (obtained by the Washington Post) to Georgia’s Secretary of State Brad Raffensperger and Georgia Governor Brian Kemp and others, the Fulton County District Attorney Fani T. Willis never explicitly state Trump by name. The subtext is clear, her office is examining at least three Georgia State laws that Trump and his surrogates may have violated and if criminal charges are warranted in Trump’s endeavor to “attempts to influence” the Georgia’s 2020 Presidential election. It is important to remind you why the Fulton County District Attorney retains jurisdiction, her office is not a witness.5
This investigation includes, but is not limited to, potential violations of Georgia law prohibiting the solicitation of election fraud 6, the making of false statements to state and local governmental bodies, conspiracy, racketeering, violation of oath of office and any involvement in violence or threats related to the election’s administration.
Read the highlights carefully…because the Grand Jury hammer dropped. To be clear the Fulton County DA does not insinuate that the Gov, Lt Gov and/or SoS are targets of the criminal investigation, again the subtext here is Trump and his surrogates are.
The next Fulton County grand jury is due to convene in March, and this office will begin requesting grand jury subpoenas as necessary at that time. At this stage, we have no reason to believe that any Georgia official is a target ofthis investigation.
In short today’s House Impeachment Managers delivered an absolutely devastating argument
“President Donald J. Trump ran out of nonviolent options to maintain power”
