PreButtle Arguments
The prebuttle arguments made by the House Impeachment Managers, was one of the smartest tactics of their oral arguments. What to look for in Trump’s presentation of counter arguments;
Constitutionality of the Second Impeachment; this is a moot argument given the Senate already voted that it has jurisdiction. The “process” argument is a canard.
Trump’s First Amendment Rights; this is an inherently flawed argument that Trump will use because bring up Brandenburg and/or Schenck literally cuts against Trump. Speech that incites violence and/or eminent lawlessness is not protected by the first Amendment. Expect Trump’s defense team to argue that Congressional Democrats used similar heated language. No really that’s what Trump legal team plans on doing
Trump isn’t responsible: the House Impeachment Managers strategically focused on Republican Members of Congress, Republican Governors rushing to the TV and Social Media imploring Trump to “say something to your supporters”.
Throughout their oral arguments most may not have picked up on the House Managers use of; “this happened to us”…”we all experienced this together”…”together”, “us”, “we” the reason this is important is it’s a subtly and nuanced way to bind the Senators as American Lawmakers, not Republican or Democrat but American.
House Impeachment Managers land the plane with with flawless precision:
In Today’s arguments, the House Impeachment Managers largely focused on Trump’s long and well established history of; encouraging violence, glorifying violence, targeting his perceived political foes with threats of violence, giving both explicit and implicit instructions to his radicalized base of followers.
Masterfully the House Impeachment Managers give a damning recitation of Trump’s history concerning violence. This brings a much sharper focus on the who, how, what, why and when of the January 6th deadly insurrection. This did not happen in a vacuum. And some of the Senate jurors are actually co-conspirators.
Cough - looking at you Hawley and Cruz and the five other Senators and one hundred and forty House Republicans that voted to object. What the hell is wrong with you Trump-licans? Enjoy being branded as the party of Insurrection and Supporters of Domestic Terrorist. Because by voting to acquit that means you’re voting against our Republic and Democracy. Have you no sense of decency? Oh wait never mind because you’re the same Trump surrogates that amplified Trump’s deadly “Big Lie”…
Was this violence forceable? Absolutely
Did Trump incite a violent insurrections, knowingly? Absolutely
Did Trump Show any remorse or acted in any way to tamp down the violence? Nope
Remarkably the House Impeachment Managers broadened the scope beyond the months leading up to the deadly insurrection. With effortlessly flawless precision the House Impeachment managers “reached back”.
By providing a clear and indisputable recitation of facts. In doing so, the totality of Trump’s previous words, going as far back as 2016 and emphasizing the “storming” of the Michigan Capitol in April 2020. They also created a forward leaning narrative, to Senators if they don’t convict “what happens next; what if Trump runs again but loses, will Trump incite another deadly insurrection”
Trump Invited Us, we are following his orders:

Trump’s lack of remorse, inaction and action
House Impeachment Manager Rep Ted Lieu - In his remarks it is apparent that Trump is pulling a “Ukraine-Call” 2.0 and that Trump is utterly incapable of accepting responsibility for his actions, his words and his inaction. Trump waited hours before he tweeted a milquetoast tweet. Trump left members of Congress and the Congressional Leadership of his own party at the murderous hands of his own radicalized base. The murderous intent of Trump’s violent mob is written in the 206+ criminal cases, in affidavits, in Memorandum in Support of Detention (see Caldwell, PEZZOLA, Bancroft - look for an article on that soon-ish)
Rep Lieu “President Trump not only has failed to show remorse, or take accountability, he has made clear that he is just beginning… If you or I make a mistake, and something very bad happens, we would show remorse. It is important to impeach that falsehood—to make clear to his supporters, & everyone watching, that what President Trump did was not acceptable. In fact, quite the opposite… Impeachment, conviction and disqualification is not just about the past, it’s about the future. It’s about making sure that no future official, no future president, does what President Trump did."
Trump called upon his Mob, giving them a time and place and reason for violence. Trump instructed his mob. And most egregiously Trump left lawmakers for dead. While Trump’s angry mob started hunting his political enemies. Trump’s Murderous-Mob planned to take some lawmakers hostage and their intent was to murder some of our lawmakers. Trump relished seeing his months long plan come to fruition. Trump never called Mike Pence, even though Trump knew Pence and his family were in mortal danger. Instead he called Senators to convince them to delay the certification.
Trump’s call to Tuberville is damning
While Lawmakers, and their Staff (and in some cases Lawmakers family members), and the Capitol Building staff were running to hide, or in some cases forced to “sheltered in place”. And the Nation watch in real-time, horrified by what we were witnessing. Trump’s Violent and blood-lusting Mob swarmed the Capitol/ Unequivocally Trump’s mob was hunting for lawmakers to murder them.
Again the criminal intent and subsequent criminal actions are written over the pages of court filings. In the 206+ cases currently being prosecuted by the Department of Justice. Moreover Trump knew that his mob was hunting Vice President Pence. Those are the brutal the facts, not “alternative facts”.

The monetary cost of Trump’s Insurrection:
The House Impeachment Managers, detailed for the Senate and General Public how much Trump’s Insurrection has caused both Federal (National Guard) and State/Local Governments;
25,000 National Guard troops deployed to Washington, 850 additional Washington Metropolitan police officer, bringing the Federal Cost to $488.8 million. That does not include the additional cost from the US Capitol Police or the US Park Police.
State and Local Governments, many of which are already facing a massive budget shortfall, largely due to the allocation of appropriations for COVID-19 testing, tracing and vaccination.
Yet all fifty (50) State Capitols required additional security and fortification because Intelligence bulletins indicated that Trump’s Proud Boys, Oath Keepers, III%ers and other far right domestic terror groups that Trump emboldened turned their attention to invade State Capitol Buildings. It is estimated that States have spent over $30 million from January 6th to Jan6th 20th.

For the record earlier today, Senate Republicans Sens Graham, Cruz & Lee huddling with Trump’s Impeachment Defense team today. What part of your impeachment oath which requires you to be impartial - did you not understand? Moreover Trump’s defends strategy questioning the Constitutionality of the Second Impeachment is a canard, the Senate Voted and this impeachment is in fact Constitutional. You recalcitrant flaming <insert pronoun> But the gambit that Trump defense team will somehow pivot to the House Democrats “are glorifying the deadly violence” that’s low, even for Trump. There was no glorification of the violence Trump incited.
To SENATE REPUBLICANS —> 2022 elections
Remember 2022 is less than a year away and guess what? There are thirty four (34) Senate seats up, twenty (20) of which are currently held by Republicans. The political price the Senate Republicans will pay will be hefty. The large Republican donors need to have a moment of conscious, keep funding these Trump-enablers or pick America, a Republic and Democracy that we all love, minus Trump & his murderous marauders. You acquitted him once and that brought us Domestic Terrorists ransacking our Capitol. The last time our Capitol was envaded was over two hundred years ago.

Did I miss something. Why don’t we know more about the Trump loyalists blocking the National Guard? Is there no record of what perhaps Tata’s involvement may have been? Is any of that wrapped up in Secrecy? I feel like the most damning stuff didn’t get mentioned, but I’ll admit, I wasn’t able to listen to all of the days’ proceedings.
