Charge(s) in Criminal Complaint: 18 U.S.C. § 1752(a)(1) - Knowingly Entering or Remaining in any Restricted Building or Grounds Without Lawful Authority, 40 U.S.C. § 5104(e)(2) - Violent Entry and Disorderly Conduct on Capitol Grounds, and 18 U.S.C. § 1752(a)(2) - Knowingly Engaging in Disorderly or Disruptive Conduct in Restricted Building.

Affidavit/Statement of Facts, supporting the criminal complaint. On January 7, 2021, the FBI received a tip, from Witness-1 (W-1) - which also disclosed an Instagram account registered to Jared Adams. According to the Affidavit Adams stated, your an Instagram “story”

“We stormed the Capitol building and the senate today! I can tell my grandchildren I was there!”

Geofencing meets FBI to Google concerning location services¹ -here’s your warrant now give us what we need. I’m certain that exchange didn’t go down like that. But in my head that’s how I want it to be, but I digress

“….Google assigns a “maps display radius a mobile device associated XXX_XXXX1994@gmail.com was present at the U.S. Capitol on January 6, 2021. Google estimates device location GPS data and information about nearby Wi-Fi using sources including; access points and Bluetooth beacons… for each location data… location data is accurate to within 10 meters, Google assigns a “maps display radius” of 10 meters to the location data point. Finally, Google reports covered device approximately 68% of the time. In this case, Google location data shows that a device associated with gmail.com for a total approximate time inside the U.S. Capitol of one hour and 47 minutes…”

In short Google uses various sources of data collection to “estimate” a Google account holder’s location. Which Google previously explained in USA-v-Chatrie

Warrant Returned executed (from Columbus OH) - notice what I highlighted? Yes that will likely be a pressure point prosecutors will press down on - should they file a Pretrial Detention Hearing.

In the event that Instagram suspends his account - I pulled down the three availed “stories” and upload them - you’ll note the affidavit repeatedly references his Instagram account²
